CASSENSt of the City of Baltimore in the State of Mary1andt being of sound mind, memory and understanding, do make, publish and declare this as and ior my Last Will and Testament, hereby revoking any and all former Wills, Codicils or testamentary dispositions that may have been made by me. I I direct my Executor, hereinafter named, to pay all my just debts and funeral expenses as promptly as possible after my death. II I give, devise and bequeath unto my husband, ELDOR A. CASSENSt if he be living at the time of my death, all of my estate and property, real, personal and mixed, of whatsoever kind, nature and description, however acquired and wheresoever situate, which I may own or have the right to dispose of at the time of my death. III If my husband, Eldor, shall fail to survive me, or if h~ and I shall die simultaneously or under such circumstances as to render it difficult or impos- sible to determine which of us was the first to die, then I give, devise and bequeath all of my estate and property hereinabove described in Paragraph II as follows: A. Two-thirds (2/3) thereof I give and bequeath: (1) Unto my children, James, David and Lois, in equal shares. (2) If any of my aforesaid children shall fail to survive me, then the share of my said child who shall predeeease met I give, devise and bequeath unto his or her descendants who are living at the time of my death, per stirpes and not per capita. (2) Fifty percent (50%) of said one-third part in equal shares among the following: (a) LUTHERAN HIGH SCHOOL, Baltimore County, Maryland; (b) AUGSBURG LUTHERAN HOME, Baltimore County, Maryland; (c) LUTHERAN HOSPITAL OF MARYLAND, INC., Baltimore City, Maryland; (d) CHURCH EXTENSION FUND OF THE SOUTHEASTERN DISTRICT OF THE LUTHERAN CHURCH-MISSOURI SYNOD; (e) THE LUTHERAN CHURCH -MISSOURI SYNOD FOUNDATION. IV I hereby nominate and appoint my husband, ELDOR A. CASSENS, as Executor of this, my Last Will and Testament, and confer upon him full power in his discretion to do any and all things necessary or desirable for the complete administration of my estate. CASSENS, of Baltimore County, Maryland, do hereby make, pub- lish and declare this as and for a First Codicil to my Last Will and Testament dated July 10, 1964. FIRST: I hereby revoke Paragraph III of my said Will and in lieu thereo do hereby substitute a new Item III to read as follows: III. If my husband, ELDOR A. CASSENS, shall fail to survive me, or if he and I shall die simultaneously or under such circumstances as to reDder it difficult or impossible to determine which of us was the first to die, then I give, devise and bequeath all of my estate and property hereinabove described in Paragraph II unto my children, JAMES, DAVID and LOIS, in equal shares. If any of my aforesaid children shall also fail to survive me, then the share of such child who shall predecease me, I give, devise and bequeath to his or her descendants living at the time of my death, per stirpes and not per capita.
