STIPULATION AGAINST LIENS
THIS AGREEMENT made the 6'h day of July,2005
by and between
HOME DESIGNS UNLIMITED, LLC
hereinafter referred to as Contractor,
AND
DAVID R. THOMPSON AND DENISE P. THOMPSON, H/W
hereinafter referred to as Owner, whereby the former undertook and agreed to construct a
single family dwelling, at LOT #60 CROSS CREEK, PHASE II, NORTH MIDDLETON TOWNSHIP,
CUMBERLAND COUNTY, PA MORE PARTICULARLY DESCRIBED IN ATTACHED EXHIBIT "A",
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of One Dollar to Contractor it in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and all parties acting
through or under them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or materials furnished by
them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said
Contractor, for themselves, their subcontractors and others under them hereby expressly
waive and relinquish the right to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them, and agree that this instrument, waiving the
right of lien, shall be an independent covenant.

County, Pennsylvania, designated as Lot No. 60 on the Final Subdivision Plan for Phase
D of the Village of Cross Creek dated 4/15/05 and recorded 6/24/05 in the Office of the
Recorder of Deeds in and for Cumberland County in Plan Book 90, Page 149, more
particularly bounded and described, as follows:
BEGlNNING at a point on the southern right-of-way of Pine Creek Drive, said point
being the northwestern comer of Lot #34; thence, along Lot #34 S 07041'18" E a distance
of 116.64' to a point; thence, along Lot # 52 and 53 S 88008'30" W a distance of 116.07'
to a point; thence, N 05001'31" E a distance of 120.00' to a point on the southern right-
of-way of Pine Creek Drive; thence, along the right-of-way by a curve to the left having a
radius of 525.00', an arc length of90.oo' and a chord bearing ofS 89053'09" E with a
chord length of 89.99 ' to a point, the place ofBBGlNNING.
Containing 11,992 sq. ft. (0.28 acres)
UNDER AND SUBJECT to the Declaration for Phases IA and II of The Village of
Cross Creek dated April 25, 2001 and recorded Apri126, 2001 in the Office of the
Recorder of Deeds in and for Cumberland County in Misc. Book 673, Page 57 as
extended to Phases B & C by the Second Amendment to the Declaration of The Village
of Cross Creek dated May 25, 2004 and recorded in Mite. Book 710, Page 421 as
extended to Phase D by the Third Amendment to the DetltratiOn of The Village of Cross
Creek dated June 23, 2005 and recorded in Misc. Book 7 t 8, Page 3396.
