STIPULATION AGAINST LIENS

THI S AGREEMENT made the b day of July, 2005, by and between
HAUBERT HOMES, INC., of 15 central Blvd, Camp Hill, pennsylvania,
17011, hereinafter referred to as "contractor", and LORI L. SEIP
of 33 southwest Avenue, Shiremanstown, cumberland County, Penn sylva-
nia, hereinafter referred to as "owner", whereby contractor under-
took and agreed to erect and construct a single family dwelling home
and improvements on that certain lot of ground situate in Silver
spring Township, Cumberland County, pennsylvania, more particularly
set forth in a Final subdivision plan for Walnut point, Phase II,
silver Spring Township, dated January 14, 2002, as prepared by Hartman
and Associates, Inc., and recorded in cumberland County plan Book 85,
page 1 and more particularly described as follows:
ALL THAT CERTAIN Lot in the property known, named and identified in
the Declaration, referred to below, as "walnut point, a Planned
community", located in silver Spring Township, Cumberland County,
pennsylvania, which has heretofore been submitted to the provisions of
the pennsylvania uniform Planned community Act, 68 pa.C.S.A. ~~5101 et
~, as amended, by the recording in the office of the Recorder of
Deeds of Cumberland County, pennsylvania, the Declaration for Walnut
point, a Flexible Residential Planned community ("Declaration"), dated
June 17, 1998, recorded June 18, 1998, in Miscellaneous Book 579, page
882, as amended by First Amended Declaration for Walnut point, a
Flexible Residential planned community ("First Amendment"), dated
November 13, 2002, recorded November 14, 2002, in Miscellaneous Book
691, Page 3769 and as amended by Second Amendment to Declaration for
Walnut point, a Flexible Residential Planned community, dated April
21, 2004, recorded April 22, 2004, in Miscellaneous Book 707, Page
3044, and designated in such Declaration as Lot No. 65 (identifying
Number), described in section 2.2 of the Declaration, as amended and
shown (and described) in Exhibit C-l of the First Amendment.
CONTAINING 0.2538 acres.
BEING Lot No. 65, Final subdivision plan for Walnut point: phase II,
dated June 14, 2002, last revised November 16, 2002, recorded in the
Office of the Recorder of Deeds of Cumberland County, pennsylvania, in
plan Book 85, page 1.
BEING the same premises which HAROLD D. STONER and MARILYN L.
STONER, husband and wife, by deed dated~ Jq, 2005 and recorded on
July If, 2005, in the Office of the Recorder of Deeds of cumberland
County pennsylvania in Deed BookJlOq, page'117'9, granted and conveyed
unto LORI L. SEIP. Also known as 52 Stone Run Drive, Mechanicsburg,
pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
contractor, for and in consideration of the sum of One ($1.00) Dollar
to contractor, in hand paid by owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the agreement
aforesaid, for themselves and their subcontractors, and all parties
acting through or under them, covenant and agree that no mechanic's
liens or claims shall be filed or maintained by them or any of them
against the said buildings and the lot of ground appurtenant thereto
for or on account of any work done or materials furnished by them or
any of them under said contract or otherwise, for, towards, in, or
about the erection and construction of the said buildings on the lot
above described, and the said contractor, for themselves, their subcon-
tractors and others under them hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims
against the said buildings or any of them and agree that this instru-
ment, waiving the right of lien, shall be an independent covenant.
