H. DONELLEY ADVERTISING doing business as SPRINT PUBLISHING & ADVERTISING, by its attorneys, KNUPP, KODAK & IMBLUM, P.C., brings this action of Assumpsit against the Defendant to recover the sum of FOURTEEN THOUSAND, TWO HUNDRED EIGHTY-SEVEN DOLLARS AND SIXTY-SIX CENTS ($14,287.66), along with interest thereon from July 6, 2002, upon a cause of action of which the following is a statement: 1. The Plaintiff, R. H. DONELLEY ADVERTISING, is a corporation organized and existing under the laws of the State of Kansas, having an office and place of business at 7015 College Boulevard, Suite 400, Overland Park, Kansas 66211, and is doing business as SPRINT PUBLISHING & ADVERTISING. 2. The Defendant, KARL E. On or about January 17, 2000, Defendant did enter into contracts with Plaintiff for the purpose of advertising in telephone book yellow pages. A true and correct copy of the Directory Advertising Orders as signed by Defendant are attached hereto, collectively marked as Exhibit "A" and made a part hereof. 4. The prices charged for said advertising services provided were just and reasonable, were the legal and market prices therefor and were the prices which the Defendant promised and agreed to pay Plaintiff therefor. 5. The balance due and owing by Defendant to Plaintiff under the contracts attached hereto as Exhibit "A" and made a part hereof totaled Twenty-Three Thousand, Two Hundred Sixty-Seven Dollars and Twenty-Four Cents ($23,267.24) as is set forth on Plaintiff s Statement of Account attached hereto, marked as Exhibit "B" and made a part hereof. 6. The Defendant paid to plaintiff and plaintiff issued certain credits against the charges aforementioned on Defendant's account certain sums of money as more particularly set forth on Exhibit "B" attached hereto and made a part hereof, in the total amount of Eight Thousand, Nine Hundred Seventy-Nine Dollars and Eighty-Seven Cents ($8,979.87). Defendant has been credited with all payments made and issued all credits to which it is entitled against the charges aforementioned, as more particularly shown on Exhibit "B" attached hereto and made a part hereof. 8.
