WAIVER OF LIENS

WHEREAS, Frankland Construction, Inc. entered into a contract with Matthew J. Hrivnak and Liane
S. Hrivnak to provided materials and perform labor necessary for new construction upon a lot of ground located
at 7 Poplar Drive, Silver Spring Township, Cumberland County, Pennsylvania, at County Parcel Number
38-19-1610-042..
See legal description attached hereto as Exhibit" A"
NOW WHEREAS, it is hereby stipulated and agreed by and between the said parties, as part ofthe said
contract and for the consideration therein set forth, that neither the undersigned contractor, any sub-contractor or
material man, nor any other person furnishing labor or materials to the said contractor under this contract shall
file a lien, commonly called a mechanic's lien, for work done or materials furnished to the said buildings or any
part thereof.
This stipulation is made and intended to be filed with the County Prothonotary, Office of Judicial
Support or County Clerk within ten days after the date in accordance with the requirements of Act of Assembly
of Pennsylvania, in such case provided.

BEING PARCEL NUMBER 38-19-1610-042.
ALL THAT CERTAIN tract of land with the buildings and improvements thereon erected situate in the
Township of Silver Spring, County of Cumberland, Commonwealth of Pennsylvania, more particularly
bounded and described in accordance with a survey of Reed Engineering, Inc. dated April 24, 1981, as
follows, to wit:
BEGINNING at a point on the southern line of Poplar Street, said point being at the intersection of the
northwestern corner ofIands now or formerly of David P. Martin; thence South twenty-four (24) degrees
thirty-three (33) minutes zero (00) seconds East along the western line of lands now or formerly of David
P. Martin a distance of one hundred twenty (120.0) feet to a point; thence South sixty-five (65) degrees
twenty-seven (27) minutes zero (00) seconds West along the northern line ofIands now or formerly of
Moyer and Muster, respectively, a distance of sixty (60.0) feet to a point; thence North twenty-four (24)
degrees thirty-three (33) minutes zero (00) seconds West along the eastern line ofIands now or formerly
of Byron R. Wolfgang, Jr. a distance of one hundred twenty (120.0) feet to a point on the southern line of
Poplar Street aforesaid; thence along said southern line North sixty-five (65) degrees twenty-seven (27)
minutes zero (00) seconds East to a distance of sixty (60) feet to the point and place of BEGINNING.
HAVING THEREON ERECTED a one-story frame dwelling known and numbered as 7 Poplar Drive.
BEING Lot No. 37 as shown on Revised Plan of Lots of Silver Spring Development Co. as recorded in
Cumberland County Plan Book 6, page 4.
BEING the same premises which Richard Runyan and Ann Runyan, his wife by Deed bearing date
August 31, 2000 and recorded in the Office of the Recorder of Deeds in and for the County of
Cumberland, State of Pennsylvania in Deed Book 231 page 494 granted and conveyed unto Matthew J.
Hrivnak and Liane S. Hrivnak, husband and wife, in fee.
