STIPULATION AGAINST LIENS
WHEREAS, Wheatland Custom Homes, Inc., a Pennsylvania Corporation, of
Pennsylvania, is about to execute contemporaneously herewith, a contract with Wheatland Custom
Homes, Inc., a Pennsylvania Corporation of Lancaster County, Pennsylvania, for the erection of a
dwelling upon a lot ofland situate as follows:
ALL THAT CERTAIN lot or tract ofland located in East Pennsboro Township,
Cumberland County, Pennsylvania in accordance with a Final Subdivision Plan of Penn Valley,
Phase V, as prepared by Hartman & Associates, Inc., Engineers and Surveyors, Camp Hill,
Pennsylvania, and recorded in Plan Book 89, Page 123, more particularly bounded and described as
follows, to wit:
BEGINNING at a point on the northern right-of-way line of Redwood Drive (a fifty
foot right-of-way), said point being located the following three (3) courses and distances from the
terminus of a curve connecting said right-of-way with the eastern right-of-way line of Larch Lane
(a fifty foot right-of-way): 1) North fifty-seven degrees twelve minutes forty-eight seconds East, a
distance of seventy-five feet (75.00) to a point; 2) by a curve to the right, having a radius of two
hundred forty feet (240.00), an arc distance of two hundred twenty-eight and eighty-five hundredths
feet (228.85) to a point; 3) by a curve to the left having a radius of three hundred feet (300.00) an
arc distance of one hundred five and forty-seven hundredth feet (105.47) to a point; thence from said
point of Beginning by Lot No. 84, North eight degrees twenty-four minutes, zero seconds East, a
distance of one hundred eighty feet (180.00) to a point; thence by same and by Lot No. 77 North
eighty-six degrees, six minutes twenty seconds East, a distance of sixty-eight and seventy-six
hundredth feet (68.76) to a point; thence by Lot No. 77, South nine degrees, forty-five minutes,
fifteen seconds East, a distance of one hundred seventy feet (170.00) to a point on the northern right-
of-way line of Redwood Drive; thence by said right-of-way line South eighty degrees fourteen
minutes forty-five seconds West, a distance of sixty-four and eighty-eight hundredths feet (64,88)
feet to a point; thence by the same, by a curve to the right having a radius of three hundred feet
(300.00) and an arc distance of sixty feet (60.00) to a point, the place of BEGINNING.
BEING Lot No. 83 on the Final Subdivision Plan of Penn Valley, Phase V, recorded
in Plan Book 89, Page 123 and containing approximately 16,881.76 square feet, more or less.
UNDER AND SUBJECT to the twenty foot drainage easements as shown on the
above mentioned plan.
ALSO UNDER AND SUBJECT, nevertheless, to easements, restnctlOns,
reservations, conditions and rights-of-way ofrecord or visible upon inspection of the premises.
NOW, the ) tJ.. A day of June, 2005, at the time of and immediately before the
execution of the principal contract, and before any authority has been given by the said Wheatland
Custom Homes, Inc., a Pennsylvania Corporation to the said Wheatland Custom Homes, Inc., a
Pennsylvania Corporation to commence work on the said building, or purchase materials for the
same in consideration of the making of the said contract with Wheatland Custom Homes, Inc., a
Pennsylvania Corporation and the further consideration of One Dollar, to Wheatland Custom Homes,
Inc., a Pennsylvania Corporation paid by Wheatland Custom Homes, Inc., a Pennsylvania
Corporation it is agreed that no lien shall be filed against the building by the contractoT, or any sub-
contractor, nor by any ofthe material men or workmen or any other person for any labor, or materials
purchased, or extra labor OT materials purchased for the erection of said building, the right to file
such liens being expressly waived.
WITNESS, our hand and seals the day and year aforesaid.
