Fahnestock, is an adult individual who resides at 14 Clifton Terrace, Carlisle, Cumberland County, Pennsylvania 17013. 4. On or about March 1,2005, Orrstown Bank loaned the sum of$7,500.00 to Jeffrey L. Fahnestock. 5. In order to secure repayment of the loan, Jeffrey L. No payment has been made against the amOunt loaned since execution of the Promissory Note. 10. Orrstown Bank has demanded payment in full from both Jeffrey L. Fahnestock and Dorothy G. Fahnestock. As of June 28, 2005, the amount due and owing is calculated as follows: Principal $7,500.00 lnterest to 6/28/05 $ 334.69 Late Charges $ 150.00 (per diem $2.812) Prepay Penalty $ 375.00 TOTAL: $8,359.69 12. COUNT I-BREACH OF CONTRACT 13. Plaintiff incorporates by reference paragraphs one through twelve as though set ORRSTOWN BANK v. JEFFREY L. FAHNESTOCK and DOROTHY G. FAHNESTOCK forth at length. 14. Jeffrey L. Fahnestock has breached the tenus of the Promissory Note by failing and refusing to make payment due in accordance with the Promissory Note. 15. Dorothy G. Fahnestock has breached the tenus of the Promissory Note by failing and refusing to make payment due in accordance with the Promissory Note. 16. All conditions precedent to recovery have been fulfilled. 17. The Promissory Note provides for the recovery of attorney fees and costs incurred by Orrstown Bank in the event it retains an attorney to collect the amount owed. WHEREFORE, Plaintiff requests that jUdgment be entered in its favor and against Jeffrey L. Fahnestock and Dorothy G.
