Defendant
COMPLAINT
1. Plaintiffs, Manish V. Mehta and Meghna M. Mehta, are adult individuals residing at
8761 Mountain Valley Road, Fairfax Station, Virginia 22039.
2. Defendant, John D. Turner, Sf., is an adult individual residing at 650 Marpete Drive,
Hampstead, Maryland 21074.
3. Defendant was the owner of the property located at 13640 Molly Pitcher Highway,
Greencastle, Pennsylvania (the, "Real Property").
4. On or about March 21,2005, Plaintiffs and Defendant executed an Agreement of Sale
for the Real Property. A true and correct copy of the Agreement is attached hereto as Exhibit "A."
5. Under Paragraph 3(G) of the Agreement, Plaintiffs and Defendant agreed that the
taxes would be pro rated upon the date of settlement.
6. Under Paragraph l5(A), Defendant agreed to convey the property free and clear of
all liens.
7. On or about May 27, 2005, Defendant sold the Real Property to Plaintiffs by
executing a Deed in Cumberland County.
8. Simultaneous with the execution of the Deed, Defendant signed a Lawyers Title
Insurance Company Affidavit, which is attached hereto as Exhibit "B."
9. The Affidavit was signed by Defendant in Cumberland County, Pennsylvania.
10. By signing the Affidavit, Defendant represented in Paragraph 12 "that all taxes. . .
against said premises. . . as of the date of this settlement are fully paid."
II. In addition, Defendant had executed a copy of the Settlement Statement which is
attached hereto as Exhibit "C".
12. According to the Settlement Statement, Defendant paid the entire 2005
countyltownship tax bill totaling $2,163.07.
13. According to the Settlement Statement, Defendant was to receive $1,291.92 as his
proration for paying the 2005 county/township taxes.
14. Defendant signed the Settlement Statement confirming the accuracy ofthe Settlement
Statement and of the figures set forth therein.
15. Defendant did not pay his county/township taxes for the 2005 tax year.
COUNT I - Fraud
16. Paragraphs 1-15 are incorporated herein by reference.
17. Defendant represented to Plaintiffs that the 2005 countyltownship taxes were paid
in full.
18. Defendant did not pay his proration of taxes from January I, 2005, through May 28,
2005.
19. Defendant knew or should have known that he was being reimbursed by the Plaintiffs
for taxes that he did not pay.
20. Defendant intentionally executed the Agreement, Affidavit, and Settlement Statement
agreeing to the terms therein and confirming the accuracy ofthe documents.
21. Defendant intentionally defrauded Plaintiffs by failing to pay the taxes after stating
that he made said payment.
22. Defendant failed to pay his proration of taxes, being $871.15, and knowingly accepted
Plaintiffs' payment of$I,291.92 for Plaintiffs' prorated share.
23. Relying on Defendant's representations, Plaintiffs paid to Defendant $1,291.92 as
stated on the Settlement Statement.
24. Because of Defendant's fraud, Plaintiffs paid an additional $871.15 to cover the
proration not paid for by Defendant during his ownership of the Real Property.
25. Plaintiffs have suffered a loss of$2,163.07 as the result of Defendant's fraudulent
acts.
26. Plaintiffs have contacted Defendant regarding repayment of this obligation, but
Defendant has failed to reimburse Plaintiffs in the amount owed.
27. As of today's date, Defendant has failed to reimburse Plaintiffs in the amount of
$2,163.07.
WHEREFORE, Plaintiffs demand judgment against Defendant in the amount of $2,163.07,
plus interest, costs, attorney's fees and any other reliefthis Court deems appropriate.
COUNT II - Breach of Contract
28. Paragraphs 1-27 are incorporated herein by reference.
29. Defendant entered into the Agreement of Sale with Plaintiffs.
30. Defendant breached the terms of the Agreement of Sale, specifically, but not limited
to, Paragraph 3(G).
31. As a result of Defendant's breach, Plaintiffs incurred damages in the amount of
$2,163.07.
WHEREFORE, Plaintiffs demand judgment against Defendant in the amount of$2, 163.07,
plus interest, costs, attorney's fees and any other relief this Court deems appropriate.
COUNT III - Quantum Meruit
32. Paragraphs 1-31 are incorporated herein by reference.
33. The Defendant is liable to the Plaintiffs and/or has been unjustly enriched in the
amount of$2,163.07.
WHEREFORE, Plaintiffs demand judgment against Defendant in the amount of $2, 163. 07,
plus interest, costs, attorney's fees and any other reliefthis Court deems appropriate.
