That on June 15, 1978, Bruce R. Berkley, Executor of
, the Estate of Louise C. McKerrocher, late of the Borough of New
Cumberland, Cumberland County, Pennsylvania, did file with
District Justice Joseph Zedlar a Complaint No. 1978-C-112 in
the Matter of the Commonwealth of Pennsylvania v. Peggy L. Gish,
of 1018 Alexandria Drive,' Pensacola, Fiorida, for acts committed
in the nature of theft by unlawful taking, in that Peggy L. Gish,
did, on or about June 10, 1978, unlawfully take from the premiS
ses at 1020 ~ridge Street, New Cumberland, Pennsylvania, one
hand-made wooden trunk containing eight hundred to one thousand
pounds of coins, proof sets, mint sets, and miscellaneous items,
all property of the Estate of Louise C. McKerrocher, with the
intent to deprive said estate thereof.

Accounting, and accompanying affidavits are attached hereto and
made apart hereof as Exhibit B).

The petition of Bruce R. Berkley respectfully repre-

1. Your petitioner is an adult individual residing at
4104 Woodvale Road, HarriSburg, Pennsylvania, and is the Executor
of the within estate, Letters Testamentary having issued on the
sixth day of June, 1978. A true copy of said Letters Testamen-
tary is attached hereto as Exhibit "A".
2. Peggy L. Gish is an adult individual currently
residing at 2703 Waldo Street, Harrisburg, pennsylvania.,
3. Peggy L. Gish is a granddaughter, and residuary
legatee, of the decedent, Louise C. McKerrocher.
4. petitioner is personally aware that the decedent,
Louise C. McKerrocher, maintained a large collection of proof
sets, mint sets, and miscellaneous coins at her apartment on
Bridge Street, New Cumberland, Pennsylvania.
5. petitioner is personally aware that during the
several years preceeding her decease, the decedent, Louise C.
.' McKerrocher, shared the aforesaid Bridge Street apartment with

7. On or about June 15, 1978, Petitioner, in his

capacity as Executor of the estate of Louise C. McKerrocher,
r executed a Criminal Complaint against Peggy 1. Gish for theft by

unlawful taking upon the facts hereinabove described.

< (a) That she, Peggy L. Gish, following the deat~ of
Louise C. McKerrocher, decided to move to Florida, and, to that
end, retained H. E. Brinkerhoff and Sons Moving and Storage to
move goods and furniture;
(b) That anlong the goods contracted to be moved, and
subsequently shipped by Brinkerhoff to Florida, were various
trunks or boxes containing coins theretofor~ belonging to Louise
C. McKerrocher;
(c) That she, Peggy L. Gish, was fully aware that
these coins were not her property.
9. Upon information and belief, during the period
Jlli1e 15, 1978, until on or about May 1, 1979, Peggy L. Gish was_
a fugitive from justice and her wpereabouts unknown.
10. Petitioner is unable to properly account for the
assets of the within estate absent an accounting from Peggy L.

Gish of the ~state assets which, it is alleged, said Peggy L.
Gish wrongfully appropriated.

I, Kathy Wilkerson, visab1y saw Peggy L. Gish of
1020 Bridge Street, New Cumberland break open luggage
cases and trunks, etc., which were known to me to
belong to Louise C. McKerrocher, and remove from same
coins and. other valuables which, in my opinion, appeared
to be worth thousands of dollars. These coins and valuables
were then packed in trunks and suit cases and were moved
to Florida.

administrator to be used solely for burial expenses.
