Re: Arthur T. Prasse Estate
Dear Sir:
As per our telephone conversstionof'this A.M., please consider this
letter as notification that all the specific and charitable bequests under
the Codicil to the Last Will and Testsment of the above-mentioned decedent
have lapsed. The reason for this lapse ,is because there is no Testsmentary
Estate. Therefore, any tax that is due,' should be assessed agsinst the Trust.
The terms of the Trust provide thst upon the death of the settlor, there
shall, be an A snd B Trust established, One of which would be tsxed st Class A
rates and the other at Class B rates, However, this never' did materislize
because the decedent's mother-in-law, for whom one of'the Trusts was to be
used, predeceased the settlor~ Therefore, all taxes assessed ",gainst the clesr
value of the Trust estate would be at the Class A rates.
Should you have any questions, pease
so 1t was our election to pay the tax on the clear ~alue of the estste
on the date of death values and not ..ait until the death of the beneficiary.
