ARMSTRONG, JR., of the Township of Hampden County of Cumbe:dand and Commonwealth of Pennsylvania, declare this to be my last Will and hereby revoke all prior Wills and Codicils made by me. ITEM I: I bequeath to my wife, Anna Kathryn Armstrong, . all of my property of a personal nature, such as clothing, jewelry and the like, as well as any automobiles which I own at my death, if she survives me. ITEM II; My wife, Anna Kathryn Armstrong, and I are now joint owners of a residence in Cumberland County, Pennsyl- vania, which is our usual home. If however, my wife. survives me and at my death our usual home is held in any manner which will not result in passage of full title to her by operation of law, I devise my entire interest in said home to her. ITEM III; All the rest of my property, of whatever nature and wherever situated, including property over which I hold a power of appointment, I bequeath, devise and appoint to Dauphin Deposit Bank and Trust Company, Harrisburg, Pennsylvania, Trustee under an Agreement of Trust executed on~ to be held by it and added to and administered as part J'f 1977, ) of the trust established by said Agreement of Trust. Said trust, con- sisting of two parts, is in existence as of the date of execution of this Will, and it is my intention to incorporate its terms herein and any amendments thereto py reference. ITEM IV: I direct that all estate, ,inheritance . and succession taxes that may be assessed in consequence of my 835 , , : . , , i: "'. .. ~~ ,f> ~ , .- -, o' ~ 2 () I death, of whatsoever nature and by whatsoever jurisdiction imposed, shall be paid out of the principal of my general estate to the same effect as if said taxes were expenses of'administra- tion; and all property includible in my taxable estate whether or not passing under this Will shall. be free and clear thereof. ITEM V: In theeverit that my wife and I die under " . . such circumstances that it cannot be determined which of us died first, she shall be deemed to have survived me for all , purposes hereunder. ITEM VI: No interest of any beneficiary of my estate, either in income or principal, shall be subJect to anticipation or to pledge, assignment, sale or transfer in any manner, nor shall any beneficiary have power in any manner to charge or encumber his interest, either in income or principal, nor shall the interest of any beneficiary be liable or subject to any manner while in the possession of the executors for the liability of such beneficiary, whether such liability arises from his debts, contracts, torts or other engagements of any type. ITEM VII: I grant to my fiduciaries and their successor or successors, the following powers in addition to and not in limitation of such powers as they may hold by law: (a) To retain any property owned by me at my death and to invest any funds of my estate or trust in any stocks, bonds, notes or other securities or property, real or personal, notwithstanding that such investments may not be of the character allowed to fidu- ciaries by statute or gerieral rules of law, it being my intention to . give them the broad- est investment powers possible. 836 , , , '" " , . . _7-!r <f" R: , .' (b) To sell or otherwise dispose of any property, real or personal, 'at any time forming apart .of my estate or trust, . for cash or upon credit, in such manner and on such terms and conditions as they may deem best, and no persons dealing with them shall be bound to see to the application of any monies paid. (c) To manage, operate, repair, improve, mortgage or lease for any term any real estate at any time held or owned by my estate. (d) To borrow money for the r! JG I 1 o () payment of taxes or for other proper purposes in the administration of my estate. (e) To distribute in cash or in kind, upon any division or distribution of my estate. (f) In general, to exercise all powers in the management of my estate which any individual could exercise in the management of similar property owned in his own right, upon such terms and conditions as to them may seem best, and to execute and deliver all instruments and to do all acts which they ~ay deem necessary or proper to carry out the purposes of this my Will. ITEM VIII: I appoint as executrix hereunder my daughter, Patricia Lee Armstrong.
