PE'l'ITION FOR 'WRIT OF HABEAS CORPUS AD SUBJICIENDUM
This Honorable Court has the Jurisdiction to Hear, Honor,
and Rule on, This Writ of Habeas Corpus Ad Subjiciendum, Pursuant
to: 42 Pa. Rules of Criminal Procedure, 108 (Al; Such Petitions
should be filed with the Sentencing Court. 42 Pa. C.S.~ 6501 et
seg.
Pursuant to the Jurisdiction vested in this Court, This
Petitioner In the above captioned Matter, Hereby applies for
Leave to file a petition for Writ of Habeas Corpus Ad Subjiciendum,
Pro Se, and In Forma Pauperis, This Petitioner seeks relief
from Illegal Confinement Resulting from application of Retro-
Active violations of Ex Post Facto Clause Laws, Which is a
violall:-iOlt of the Pennsylvania Constitution, Article I, Section
17; ~s well as a violation of the United States Constitution,
Arti~~e I, ~ 10, D.S.Const. By the Pennsylvania Board of
Probation and Parole.

PROCEDURAL HISTORY
1. The Petitioner, Floyd Eugene Barrick, Pro Se, Was
Convicted March 2000 of 18 S 3122.1, statutory Sexual Assault,
18 93126 ssA8, Indecent Assault of a Person less than 16 yrs~
of age, and 18 s6301 99A, Corruption of Minors',O.T.N. Numbers,
(H0617691)~ (H0617691)~ (H0617691)~ These offenses took place
on May 21, 1999. This Petitioner was Sentenced to 1 t to 7 yrs
for Statutory Sexual Assault and The two other charges merged
for sentencing purposes. The Petitioner was given Credit from
September 8, 1999, The Petitioner's maximum sentence expires
January 22, 2010 according to the Parole Board, ( SEE: Attached
exhibit ).
RESPONDENTS
2. Respondent Franklin Tennis is the Superintendent at
S.C.I.Rockview where this Petitioner is currently Incarcerated.
3. Respondents from the Pennsylvania Board of Probation
and Parole have violated this Petitioner's Ex Post Facto Clause
Rights when they applied retroactive Laws and Statutes to this
petitioner in denying him Parole October 12, 2004 for failure to
take or complete Sex Offender Treatment Programs Under 42 Pa.
C.S.A. 9 9718.1, which can not be held retroactively against
this petitioner.

ARGUMENT
42 Pa.C.S.A.~9718.1 can not be held retro-active against this
Petitioner. SEE: Section 3 of Act No.200G-98 (December 20, 2000),
P.L.721,No.98,Id at 80, Provides in Relevant Part;
This Act Shall apply as follows:
(1) [TJhe addition of 42 Pa. C.S.~9718.1 shall apply to
offenses committed on or after the effective date of this
act.
(2) The addition of 42 Pa.C.S.~9718.1 shall not preclude
consideration of the factors set forth in that section in
granting or denying parole for offenses committed before
the effective date of this act, except to the extent that
consideration of such factors is precluded by the Constitution
of the United states or the Constitution of the Commonwealth
of Pennsylvania.
Article I, Section 17 of the Pennsylvania Constitution
protects Pennsylvania citizens from "Ex Post Facto Laws"~ This
mandated rendition forbids Pennsylvania officials from applying
Laws enacted after an offense has been committed.
Article I 9 10 of the United States Constitution provides,
" No state shall. ..pass any bill of attainder, Ex Post Facto
Law or Law imparing the obligation of Contracts...U.S.Const.
Art. I ~ 10.

IN: MICKENS-THOMAS V. VAUGHN, 355 F.3d 294 (ard Cir.2004)
The Court Stated; "The Board's recent requirement that Thomas
participate in the "admitter" part of Sex Offender therapy
program to qualify for parole is in essence a retroactive
application of 42 Pa.Stat.Ann.~9718.1, enacted in December 2000."
" That statute provides that a Sexual offender--"Shall not be
eligible for Parole unless the Offender has...Participated in
[ The sex offender therapy program prescribed by the Department
of Corrections]."
This Court has the Jurisdiction to order this Petitioner
released from custody. It is well settled Law that this
Petitioner can not be required to take Sex Offender Treatment as
required by the Parole board in their decision in the attached
exhibit. . Therefore, this Court should Order this Petitioner
released on Parole.

RELIEF SOUGHT
WHEREFORE, Petitioner Floyd Eugene Barrick moves this
Honorable COurt to Grant the Following Relief:
a) Accept Jurisdiction over this Matter.
b) Issue an Order directing the Superintendent at
S.C.I.Rockview to deliever this petitioner for an evidentiary
Hearing.
c) Hold such evidentiary hearings as this Court may
deem necessary or appropriate1
d) Appoint COunsel to represent this petition at the
evidentiary hearing if required or needed.
e) Issue a Writ of Habeas Corpus Ad Subjiciendum to
free this petitioner from his Illegal confinement.
f) Require Respondents to show Cause why a Writ should
not be issued.

This Petition for Writ of Habeas Corpus Ad Subjiciendum,
is brought Pursuant to 42 Pa.C.S.s5 901, 911, and 12 P.S.
S 1901 of Section 6502 la) Pa. R. Crim. P. 1701 la), SEE: also

This Petition is to seek relief from Illegal Confinement

permission from this Honorable Court, To proceed In Forma pauperis
status pursuant to 28 U.S.C.9 1915, and states the following
facts In Support;
1. Petitioner is an inmate, Incarcerated at S.C.I.Rockview,
and has limited funds.
2. Petitioner does not own anything of value, or have
any bank accounts.
3. Petitioner receives a monthly wage of approx. $20.00
dollars, which is used for his Hygene and Legal Supplies.
4. Petitioner does not receive any money from any other
Source. Therefore, This petitioner can not afford the costs of
this action.

This Court dismissed this petitioner's petition for
Writ of Habeas Corpus, Ad Subjiciendum as frivolous due to
the fact that this Court claims it is without Jurisdiction to
hear the petition. This Court also denied this petitioner's
request for in Forma Pauperis. By Order Dated July 28th, 2005.
This Honorable Court has Jurisdiction to Hear, Honor,
and Rule on This Writ of Habeas Corpus, Ad Subjiciendum, Pursuant
to; 42 Pa.Rules of Criminal Procedure, 108 (A); and such Petitions
