Hoke of 4 GOLDENROD DRIVE, CARLISLE, PA 17013, is about to execute contemporaneously herewith, a contract, with D. Cully, Inc. tdba C & C Construction of 509 Kedron Avenue, Folsom, PA 19033, for the erection of a building upon premises commonly known as Lot 3 Wood Drive, Township Silver Spring, Cumberland County, Pennsylvania, as set forth in the deed dated 06/25/03, recorded at Book 259, Page 1264, in the Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, , at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. . Hoke / Exhibit A ALL that ce.rtain piece, parcel or lot ofunirnproved land situated in the Township of Silver Spring, COUlllty of Cumberland and Commonwealth of Pennsylvania, more particularly bounded and described as follows: BEGINNING: at a P.K. nail in the center of Woods Drive (T-585)at the dividing line between Lots Nos. 3 and 4 as shown on the hereinafter mentioned plan of lots; thence along said dividing line between Lots Nos. 3 and 4 passing through a concrete monument on the southem dedicated right-of-way line of said Woods Drive, South 45 degrees 58 minutes II seconds West, a distance of 911.13 feet to a steel rebar at lands now or fonnerly of Dennis and Linda L. Hoke; thence along said latter lands, North 58 degrees 20 minutes 19 seconds West, a distance of 284.31 feet to a steel rebar at the dividing line between Lots Nos. 2 and 3 as shown on the hereinafter mentioned plan oflots; thence along said dividing line between Lots Nos. 3 and 2, North 46 degrees 10 minutes 13 seconds East, (passing through a concrete monument at the southern dedicated right-of-way line of Woods Drive (T -585), a distance of 909.70 feet to a P .K. nail in the center of said Woods Drive; thence along the center line of said Woods Drive, South 58 degrees 51 minutes 42 seconds East, a distance of281.59 feet to a P.K. nail in the same at the dividing line between Lois Nos. 3 and 4 as shown on the hereinafter mentioned plan oflols, the place of BEGINNING. BEING LOT NO, 3 as shown on a plan of lots entitled "Final Subdivision Plan for Leah J.
