WHEREAS, SEAN KEEFE and KIM LEE of 817 Highland Court, MECHANICSBURG, PA
17050, is about to execute contemporaneously herewith, a contract, with MCNAUGHTON
HOMES of 4400 Deer Path Road, Harrisburg, PA, for the erection of a building upon
premises commonly known as 5245 JENNIFER CIRCLE, Township Hampden, Cumberland
County, Pennsylvania, as set forth in the deed dated 10/05/94, recorded at Book 112, Page
1058, in the Recorder's Office for Cumberland County, Pennsylvania, as more specifically
described in Exhibit "A" which is incorporated herein and attached hereto.
NOW, July 15, 2005, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor
to commence work on the said building, or purchase materials for the same in consideration
of the making of the said contract with Contractor and the further consideration of One
Dollar ($1.00), to contractor paid by Owner, it is agreed that no lien shall be flied against the
building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen
or any other person for any labor, or materials purchased, or extra labor or materials
purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL that certain piece, parcel or lot ofland, together with improvements, situated
in Hampden Township, Cumberland County, Ponnsylvania, and bounded and described as
follows:
BEGINNING at a point on the Northern right-of-way line of J ennifor Circle
(50.00 feet wide), said point b~ing located at the Southeastern comor of Lot No. 69; then along
the Eastern boundluy line ofLat No. 69, and through a proposed 25.00 fool wide drainage
easement, North 28 degrees 19 minutes 47 seconds Wl!St, for a distance of 114.18 feet, to a point
in line of other lands of Good Hope F =5 South - Phase.U; then along said other lands ofP.base
II. and along said proposed 25.00 foot wide drainage easement, North 75 degrees46 minutes 53

to a point on the Northern right-of-way line of Jennifer Circle; then along said right-of-way line
on the arc of a circle curving to thelefl, having a tadiUl! of 190.00 feet, and an arc length of 92.85
feet, to a point and the place of BEGINNING.
