COMPLAINT
AND NOW comes the Plaintiff, Christopher Moore, by and through his attorney,
Karl E. Rominger, Esquire, and in support of this Complaint avers as follows:
1. Plaintiff Christopher Moore is an adult individual who resides at 1128 Pheasant
Drive, Carlisle, Cumberland County, Pennsylvania.
2. Defendant Joseph Boyer is an adult individual who resides at 16 Hill Road,
Newville, Cumberland County, Pennsylvania.
3. On or About July 26,2003, Plaintiff went to an off mad park in Luzerne County.
4. Defendant was also at the offroad park at the same time as Plaintiff.
S. At some point an accident occurred, resulting in Plailntiffbeing taken in an
ambulance for injuries and a broken arm.
6. Plaintiff has lost wages for three (3) months and had to pay an ambulance bill.
Plaintiffs pain and suffering and emotional distress was a shock to his nervous
system.

8. Defendant Joseph Boyer had a duty to Plaintiff
.
9. Defendant Joseph Boyer was negligent in that:
(a) Defendant rolled his vehicle injuring Plaintiff
(b) Driver failed to keep an assured clear distance;
(c) Driver failed to keep alert and maintain a proper and adequate watch for the
presence of other vehicles on the roadway;
(d) Driver drove a vehicle in a manner endangering persons and property and in a
reckless manner with careless disregard for the rights and safety of others and
in violation of the Motor Vehicle Code of the Commonwealth of
Pennsylvania.
(e) Driver was negligent for turning too quickly and rolling the vehicle.
(f) Such other acts or omissions of negligence as may be revealed in the course of
discovery or a trial in this case.
WHEREFORE, Plaintiff respectfully requests that trhis Honorable Court enter an
award in his favor in an amount not more than the statutory limits for compulsory
arbitration, including costs of this suit and attorney's fees.

ANSWER AND NEW MATTER
AND NOW, comes the Defendant, Joseph Boyer, by and through his counsel,
Summers, McDonnell, Hudock, Guthrie & Skeel, L.L.P., and Kevin D. Rauch, Esquire,
and files the following Answer and New Matter and in support thereof avers as follows:
1. After reasonable investigation, the Defendant has insufficient information
as to the truth or falsity of said averments, therefore said averments are denied and
strict proof thereof is demanded at the time of trial.
2. Denied as stated. The Defendant's address is 16 Hill Road, Carlisle,
Pennsylvania 17013.
3. Admitted.
4. Admitted.
5. Admitted in part, denied in part. It is admitted that an accident occurred
involving the Defendant's vehicle. The remainder of the allegations in paragraph 5 are
denied generally pursuant to Pa.R.C.P. 1029(d) and (e). Strict proof thereof is
demanded at the time of trial.
6. Paragraph 6 states a legal conclusion to which no response is required. To
the extent, however, that a response is deemed necessary, said averments are denied

7. In response to paragraph 7, the Defendant reiterates and repeats all his
responses in paragraphs 1 through 6 as if fully set forth at length herein.
8. Admitted.
9. Admitted in part, denied in part. It is admitted that the Defendant was
negligent in the operation of his vehicle on the date, time, and place of the subject
accident. The remainder of the allegations in paragraph 9 and all of its subparts state legal
conclusions to which no response is required. To the extent, however, that a response is
deemed necessary, said averments are denied generally pursuant to Pa.R.C.P. 1029(d)
and (e). Strict proof thereof is demanded at the time of trial.
WHEREFORE, Defendant, Joseph Boyer, respectfully requests this Honorable
Court enter judgment in his favor and against the Plaintiff with costs and prejudice
imposed.
NEW MATTER
10. The motor vehicle accident in controversy is subject to the Pennsylvania
Motor Vehicle Financial Responsibility law and this Defendant asserts, as affirmative
defenses, all rights, privileges and/or immunities accruing pursuant to said statute.
11. Some and/or all of Plaintiff's claims for damages are items of economic
detriment which are or could be compensable pursuant to either the Pennsylvania Motor
Vehicle Financial Responsibility law and/or other collateral sources and same may not be
duplicated in the present lawsuit.
12. The Plaintiff assumed the risk of injury.
13. To the extent that the Plaintiff has selected the limited tort option or is
deemed to have selected the limited tort option then this Defendant sets forth the relevant
provisions of the Pennsylvania Motor Vehicle Financial Responsibility Law as a bar to the
Plaintiff's ability to recover non-economic damages.
14. This Defendant pleads any and all applicable statutes of limitation under
Pennsylvania law as a complete or partial bar to any recovery by Plaintiff in this action.
WHEREFORE, Defendant, Joseph Boyer, respectfully requests this Honorable
Court enter judgment in his favor and against the Plaintiff with costs and prejudice
imposed.

DEFENDANT'S MOTION TO COMPEL DISCOVERY AND REQUEST FOR
SANCTIONS BEFORE HESS. J.
AND NOW, comes the Defendant, Joseph Boyer, by and through his attorneys,
Summers, McDonnell, Hudock, Guthrie & Skeel, L.L.P., and Kevin D. Rauch, Esquire,
and files the following Motion to Compel Discovery Answers and Responses and in
support thereof avers the following:
1. On September 28, 2005, Defendant served Plaintiff with Interrogatories
and Request for Production of Documents relative to the above-referenced matter. (A
true and correct copy of correspondence between the parties dated September 28,
2005, is attached hereto as Exhibit "A".)
2. In accordance with Pennsylvania Rules of Civil Procedure 4009, Plaintiff's
responses to Defendant's Interrogatories and Request for Production of Documents
should have been received by October 28, 2005.
3. On October 28, 2005, Plaintiff's counsel forwarded a letter to Defendant's
counsel requesting a 30-day extension. (A true and correct copy of correspondence
between the parties dated October 28, 2005, is attached hereto as Exhibit "B".)
4. On November 4, 2005, Defendant's counsel forwarded a letter to Plaintiff's
counsel granting the extension which would require the discovery responses to be
received by November 27, 2005. (A true and correct copy of correspondence between

PURSUANT TO Pa.R.C.P. 4019
AND NOW, comes the Defendant, Joseph Boyer, by and through his attorneys,
Summers, McDonnell, Hudock, Guthrie & Skeel, L.L.P., and Kevin D. Rauch, Esquire,
and files the following Motion for Sanctions, and in support thereof, avers the following:
1. On September 28, 2005, Defendant served the Interrogatories and
Request for Production of Documents relative to the above-referenced matter. (A true
and correct copy of correspondence between the parties dated September 28, 2005 is
attached hereto as Exhibit "A".)
2. In accordance with Pennsylvania Rules of Civil Procedure 4019, Plaintiffs
responses to Defendant's Interrogatories and Request for Production of Documents
should have been received by October 28,2005.
3. On October 28, 2005, Plaintiffs counsel forwarded a letter to Defendant's
counsel requesting a 30-day extension. (A true and correct copy of correspondence
between the parties dated October 28,2005, is attached hereto as Exhibit "B".)
4. On November 4, 2005, Defendant's counsel forwarded a letter to Plaintiff's
counsel granting the extension which would require the discovery responses to be
received by November 27, 2005. (A true and correct copy of correspondence between
the parties dated November 4,2005, is attached hereto as Exhibit "C".)
5. On March 9, 2006, Defendant filed a Motion to Compel the Plaintiff's
discovery responses in the above-referenced matter. (A true and correct copy is
attached hereto as Exhibit "0".)
6. On March 14, 2006, Judge Hess ordered the Plaintiff to provide the
Defendant with full and complete Answers and Responses to Defendant's
Interrogatories and Request for Production of Documents within twenty (20) days. (A
true and correct copy of the Order of March 14,2006, is attached hereto as Exhibit "E".)
7. On March 17, 2006, Defendant forwarded a letter to opposing counsel
enclosing the Judge's Order and requesting the Plaintiff's discovery responses by April
4, 2006. (A true and correct copy of correspondence between the parties dated March
17,2006 is attached hereto as Exhibit "F".)
8. On April 17, 2006, the undersigned granted an extension to Plaintiff's
counsel to provide his client's discovery responses by April 19, 2006. (A true and
correct copy of correspondence between the parties dated April 17, 2006, is attached
hereto as Exhibit "G".)
9. To date, Defendant has not received any further correspondence from
Plaintiff or Plaintiff's counsel regarding Defendant's Interrogatories or Request for Production of Documents.
10. It is necessary for proper defense of this lawsuit that Plaintiff files full and
complete responses to Defendant's discovery requests.
11. Accordingly, pursuant to Pennsylvania Rule of Civil Procedure 4019,
Defendant respectfully requests this Honorable Court to enter an Order refusing to allow
the Plaintiff to introduce any evidence regarding liability or damages.
12. Counsel for the Defendant certifies that he has attempted contact with
Plaintiffs counsel in an effort to resolve this discovery dispute as set forth above.
Despite such attempts by Defendant's counsel, Plaintiffs discovery responses have not
been received by Defendant's counsel.
WHEREFORE, Defendant, Joseph Boyer, respectfully requests this Honorable
Court enter an Order dismissing the Plaintiffs case against the Defendant with
prejudice.
