COMPLAINT TO THE HONORABLE JUDGE OF SAID COURT: COMES NOW BG&C Realty Associates, LLC, doing business as Shenandoah Apartments, Plaintiff in this cause of action, and respectfully shows this honorable Court the following: I. BG&C Realty Associates, LLC, doing business as Shenandoah Apartments (hereafter, "Plaintiff') is a Pennsylvania limited liability company doing business at 105 East Allen Street, Mechanicsburg, PA 17055. 2. Roxanne Volland, (hereafter, Decedent) died May 8, 2005 and was a resident of the Shenandoah Apartments at the time of her death. Her address was 105 East Allen Street, Apartment 306, Mechanicsburg, PA 17055. 3 " 3. The Executor of the Estate of Roxanne Volland is Kieth L. Banney. No service on the Executor is necessary, as this matter is an appeal from a District Justice Case and Executor is represented by Counsel. 4. In accordance with the Pennsylvania Rules of Civil Procedure, a copy of this Complaint will be served upon Counsel for the Executor. 5. On or about July I, 1995, Decedent entered into an agreement to lease an apartment for a period of I year, paying $520.00 per month for use of the apartment and was subsequently renewed on a yearly basis. 6. At the time of her death, the monthly lease payment was $635.00. 7. A copy of the lease agreement (hereafter, the "Contract") by and between Plaintiff and Decedent is attached as Exhibit "I" and is hereby incorporated by reference. 8. Decedent's Estate currently owes lease payments in an amount totaling $635.00, in accordance with the terms of the contract. 9. A copy of the Move- In / Move-Out condition Report showing the condition of the dwelling before and after Decedent's period of occupation is attached as Exhibit "2" and is hereby incorporated by reference. 10. After her death, an inspection of the apartment formerly occupied by Decedent showed damage including, but not limited to: bums in carpets, damage to vinyl kitchen flooring, stove, oven, window blinds and refrigerator as well as an overall filthy condition necessitating professional cleaning and repainting of walls and other surfaces. II. The cost for the repair, replacement and/or remediation of damage in the apartment was $4,156.62. As such, Plaintiff has been damaged in that amount. 4 , 12. Demand has been made upon Decedent's Estate for payment of the amounts owed but the Executor of the Estate has refused and continues to refuse to pay the amounts owed. COUNT - 1 BREACH OF CONTRACT - RENT DUE AND OWING 13. Plaintiff hereby incorporates paragraphs 1 through 12 ofthis Complaint as if set- forth at length herein. 14. On or about July 1, 1995, Decedent made application for the lease of an apartment in Plaintiffs facility. 15. As set forth in Paragraph 3 of the Contract between the parties, Decedent agreed to pay the sum of $520.00 as monthly rent, payable in advance on the first day of each month during the term of the lease. 16. At the time of her death, the agreed-upon monthly rent charge was $635.00. 17. As such, Decedent is responsible for monthly payment of rent in the amount of $635.00. 18. Rent in the amount of$635.00 is currently due, owing and unpaid. 19. Plaintiff has demanded payment from Defendant, but Defendant has refused and continues to refuse payment in breach of the Agreement. 20. Plaintiff has been damaged by the refusal of Decedent's Estate to pay for the lease payment due and owing, in breach of the Contract by and between the parties. WHEREFORE, Plaintiff respectfully requests that this honorable Court enter an Order as follows: a. Granting judgment for Plaintiff in the amount $635.00 for rent due and owing, plus 6% prejudgment and post judgment interest per annum, or as determined by the Court, inclusive of interest and costs; 5 b. Granting Plaintiff its expenses, including all costs of court, reasonable attorney fees of$715.00 incurred to date in connection with this action, and; c. Granting such and other relief as the Court deems appropriate COUNT-2 BREACH OF IMPLIED CONTRACT - RENT DUE AND OWING 21. Plaintiff hereby incorporates paragraphs I through 20 of this Complaint as if set forth at length herein. 22. Pursuant to rule I 020( c ) of the Pennsylvania Rules of Civil Procedure, Plaintiff pleads the following alternative cause of action 23. On or about July I, 1995, Decedent made application for the lease of an apartment in Plaintiff s facility. 24. On or about July I, 1995, Plaintiff accepted Decedent's offer and application to lease an apartment. 25. The facts, as set forth above, establish an implied-in-Iaw and an implied-in-fact contract. 26. Due to the existence of the implied-in-Iaw and implied-in-fact contract, the Plaintiff is entitled to compensation for services rendered in providing the apartment to Decedent, in accordance with the terms of the contract. 27. Plaintiff has demanded payment from Decedent's Estate under the terms ofthe implied-in-fact and implied-in-law contract, but the Executor of the Estate has refused payment. 6 28. Plaintiff has been damaged by the refusal of Decedent's Estate to pay for the lease payment due and owing, in breach of the implied-in-law and implied-in-fact contract. WHEREFORE, Plaintiff respectfully requests that this honorable Court enter an Order as follows: a. Granting judgment for Plaintiff in the amount of$635.00 for rent due and owing, plus 6% prejudgment and post judgment interest per annum, or as determined by the Court, inclusive of interest and costs; b. On or about July I, 1995, Decedent made application for the lease of an apartment in Plaintiff s facility. 41. As set forth in Paragraph 13 of the Contact by and between Plaintiff and Decedent which is attached to this Complaint as Exhibit" I ", Decedent agreed to use good care when using the leased premises. Further, Decedent agreed, when 8 signing the lease agreement to " . . . pay for all repairs to the Leased Premises, its contents, or any property of Landlord caused by lack of good care by Tenant. . .. ". 42. after her death, an inspection of the apartment formerly occupied by Decedent showed, damage including, but not limited to: bums in carpets, damaged vinyl kitchen flooring, stove, oven, window blinds and refrigerator as well as an overall filthy condition necessitating professional cleaning and repainting, which cost $4,156.62 to repair and/or replace. As such, Plaintiff has been damaged in that amount. 43. As such, Decedent is responsible for paying Plaintiff for the costs it incurred in repairing the damage. 44. Plaintiff has demanded payment from Defendant, but Defendant has refused and continues to refuse payment in breach of the Agreement. Due to the existence of the implied-in-Iaw and implied-in-fact contract, the Plaintiff is entitled to compensation for costs it incurred in repairing the damage in the apartment. 51. Plaintiff has demanded payment from Decedent's Estate under the terms of the implied-in-fact and implied-in-Iaw contract, but the Executor of the Estate has refused payment. 52. Plaintiff has been damaged by the refusal of Decedent's Estate to pay for the costs it incurred in repairing the damage, in breach of the implied-in-Iaw and implied-in-fact contract. On May 9, 2005, Keith Baney, the father of Roxanne Volland, orally notified Susan Updegraff, manager of plaintiff's apartment complex, that Roxanne died May 8, 2005. 63.) On May 27, 2005, Keith Baney, who resides at 64 Ashburg Drive, Mechanicsburg, was appointed executor of the Last Will and Testament of Roxanne Volland by the Register of Wills of Cumberland County, 64.) At all times material to this litigation defendant knew the contents of apartment 105 were property of the tenants, Roxanne Volland and Peter J. Owens. 4 ,. 65.) The contents of the apartment owned by Roxanne Volland were removed from the premises before May 30, 2005. 66.) The contents of the apartment which were not removed by May 30, 2005, were property of Peter J. Owens. 67.) The plaintiff maintained an escrow account pursuant to Paragraph 4 of the lease, titled "Security Deposit" which contained money of the tenants. 68.) Plaintiff did not provide Keith Baney, Executor ofthe Roxanne Volland Estate with a written list of any damages to the leasehold premises for which plaintiff claims Roxanne Volland was responsible within 30 days of termination of the lease. 69.) Plaintiff did not provide Peter J. Owens with a written list of any damages to the leasehold premises for which plaintiff claims he was liable within 30 days ofthe termination of the lease. 70.) Within 30 days of the termination of the lease, plaintiff knew Keith Baney, Executor, resided at 64 Ashburg Drive, Mechanicsburg. PLAINTIFF'S RESPONSE TO DEFENDANT'S NEW MATTER COMES NOW BG&C Realty Associates, LLC, doing business as Shenandoah Apartments, Plaintiff in this cause of action, and respectfully shows this honorable Court the following in response to Defendant's New Matter: 62. Denied. Plaintiff's Apartment Manager, Susan Updegraff learned of the death of Roxanne Volland from a resident on or about May 16,2005. 63. Admitted. 64. Admitted. 65. After reasonable investigation, Plaintiff is without knowledge or information sufficient to form a belief as to their truth of the averments contained in paragraph 126. Strict proof is demanded at trial, if relevant By way of further answer, Plaintiff's apartment manager recalls that all of the contents of the apartment were removed by the end of May, 2005. 66. Denied. All contents ofthe apartment were removed by the end of May, 2005. 67. Admitted. 68. Denied. Keith Baney and Helen Baney were provided a copy of the "move-out" condition sheet in a meeting on June 13, 2005, showing the condition of the property at the beginning of the period of occupancy and at the end of the period of occupancy. See Exhibit "2"attached to Plaintiff's Complaint. 69. Admitted. Plaintiff has not been able to locate Peter J. Owens since the death of Roxanne Volland. Moreover, liability under this lease is joint and severable. 70. Admitted. Plaintiff's apartment manager called the Cumberland County Register of Wills to obtain the address for the Executor of Roxanne Volland's Estate. WHEREFORE, Plaintiff respectfully requests that this honorable Court enter an Order as follows: a. Granting judgment for Plaintiff in the amount of at least $635.00 for rent due and owing, judgment in the amount of at least $4,156.62 for damages to the apartment, plus 6 % prejudgment and post judgment interest per annum, or as determined by the Court, inclusive of interest and costs; b. Granting Plaintiff its expenses, including all costs of court, reasonable attorney fees of $715.00 incurred to date in connection with this action, and; c.
