CHELSEA RAE SENIC, CIVIL ACTION - LAW NO. 05-3866 Defendant JURY TRIAL DEMANDED COMPLAINT AND NOW, comes the Plaintiff, Joshua D. Ivey, and complains against the Defendant as follows: The Plaintiff, Joshua D. Ivey, is an adult individual residing at 1009 Goodhope Road, Mechanicsburg, Cumberland County, Pennsylvania 17050. 2. The Defendant, Chelsea Rae Senic, is an adult individual residing at 355 Martingale Drive, Camp Hill, Cumberland County, Pennsylvania, 17011. On or about March 24, 2005 at 6:15 p.m., Plaintiff was operating a 1998 Volkswagen, Jetta, at which time he pulled into the Sonoco service station at 6025 Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania ("Sonoco"). 4. Plaintiff entered the parking area of Sonoco through the southern entrance of the lot and parked his vehicle at the air pump on the southern side of Sonoco's parking lot. 5. At the same time as Plaintiff was pulling into the air pump, Defendant was operating a 1994 Saturn SC2 Coup, also driving through the parking lot of the Sonoco. 6. As Plaintiff was stopping his vehicle at the air pump, Defendant pulled through the line of gasoline pumps located in the center of the Sonoco parking lot in a direction as to approach Plaintiffs vehicle. 6. After proceeding through the gasoline pumps, Defendant proceeded to strike Plaintiff's vehicle with her vehicle. 7. The front, passenger side bumper of Defendant's vehicle impacted the passenger side front of Plaintiff's vehicle approximately at the location of the passenger side front tire of Plaintiff's vehicle. Defendant was traveling approximately twenty (20) miles per hour through the Sonoco parking lot. 9. Defendant was operating her vehicle in a negligent and unsafe manner in that she: a. was traveling too fast for safe travel through a parking lot; and b. failed to maintain control of her vehicle; and c. failed to be alert for other drivers. 10. As a direct result of Defendant's negligence, Plaintiff has suffered damages in the form of property damage to Plaintiff's vehicle. 11. Plaintiff's has suffered damages in the amount of. a. one thousand four hundred fifty-three and. 37/100 Dollars ($1,453.37) for body work to repair Plaintiff's vehicle; and b. one hundred ten and 43/100 Dollars ($110.43) to replace a tie rod; and c. seventy and 33/100 Dollars ($70.33) to replace a tire; and d. one hundred eighty two and 32/100 Dollars ($182.32) to store Plaintiff's vehicle during the time repairs were being made.
