COMPLAINT
AND NOW COMES, Mark W, Allshouse, Esquire, Plaintiff, by and through his attorney
Stacia A. Ritter, Esquire, and bring the following Complaint and in support thereof avers as
follows:
1, Plaintiff, Mark W, Allshouse, Esquire is an adult individual and attorney with an
office located at 4833 Spring Road, Shermans Dale, Perry County, Pennsylvania 17090,
2, Defendant, Brian A, Gregory, is an adult and individual citizen of the
Commonwealth of Pennsylvania, who resides at 2121 Douglas Drive, Carlisle, Cumberland
County, 17013,
3, The Defendant and the Plaintiff entered into a Fee Agreement on August 16, 2004
in Carlisle, Cumberland County, Pennsylvania, whereby the Plaintiff agreed to represent the
Defendant in his custody matter in the Court of Common Pleas of Cumberland County,
4, In return, Defendant agreed to a retainer fee of $1 ,400,00, and once exhausted
agreed to make payments in full on a monthly basis or interest would be charged,
5, Further, it was also agreed that Allshouse reserved the right to terminate any
attorney-client relationship due to nonpayment of fees or costs, A true and correct copy of the
Fee Agreement is attached hereto and made a part hereof Exhibit "A",
6, Plaintiff performed all serves requested in the custody litigation in a good and
professional manner.
7. On March 23, 2005, nearly six months since the date of the original invoice,
Plaintiff sent a letter to Defendant requesting payment of his final invoice, A true and correct
copy of that letter is attached hereto and made a part hereof as Exhibit "B",
8, Despite request, Defendant has refused to make any payments and currently owes
the Plaintiff one thousand four hundred thirty-two dollars and fifty cents ($1,432.50) in legal fees
for services performed by the Plaintiff on his behalf, A true and correct copy of Plaintiff's
Invoice is attached hereto and made a part hereof as Exhibit "C",
9, The Defendant is in breach of the Fee Agreement in that he has not made any
payments on legal fees owed since November 15, 2004,
10, As a result of Defendant's breach of contract Plaintiff has incurred attorneys fees
in and cost in the amount of $500,00, which amount continues to accrue,
WHEREFORE, Plaintiff demands judgment against Defendant in the amount of
$1,432,50 together with interest, cost of suit and attorneys fees.

RE: Custody Fee Agreement
Dear Brian:
I am glad you contacted me to represent you! This letter sets forth the agreement
concerning my representation of you. This agreement shall become effective upon receipt of a
countersigned copy of this letter and the retainer fee, A written agreement is required by the
Rules of Professional Conduct.
1. You hereby agree to pay a retainer fee of $1,400,00, I will apply your retainer
against time expended on your behalf, and at such time as that amount is exhausted, you will be
billed regularly for additional time expended,
2, The basis for my fee is the amount of time spent on your matter. It is impossible
to determine in advance the amount of time that will be needed to complete your case, My
billing is based on an hourly rate of $125,00 per hour, This hourly rate will prevail until
December 31, 2004, after which, due to rising costs and overhead expenses, the hourly rate will
be subject to increase in accordance with the then existing hourly rate schedule, I will bill you
periodically on a time-expended basis. Fractions of hours are computed in periods of not less
than two-tenths (.02) of an hour and the interruption of other work is taken into consideration,
You will not be billed for clerical or secretarial time, If it is necessary to prepare interrogatories,
pleadings, agreements or similar legal documents on your behalf, there will be a base charge for
such pleadings or agreements, plus an hourly rate for amendments and revisions, For the
preparation of certain documents, you will be billed on a flat rate basis rather than a time
expended basis,

3, I expect you to keep current with rny billings. I reserve the right to terminate my
attorney-client relationship for non-payment of fees or costs.
4, "Costs" are my out-of-pocket expenses, such as filing fees, transcripts,
photocopies, long distance phone calls and, if necessary, appraisals and accounting fees, Costs
will be billed on a periodic basis,
Please date and countersign this agreement and return the original, together with the
retainer, in the enclosed return envelope, so that we will have a mutual memorandum of our
understanding, You should retain the copy for your file,

Dear Brian:
I am sornewhat perplexed at your failure to contact me or to make any payment
with regard to your outstanding invoice. I have attached a copy of the invoice for your
reference, You have carried an overdue balance since October I, 2004 and your last
payment was November 15, 2004,
I understand that financially, times may be difficult. I would like to believe that
this is the case, However, because you have not contacted rne to advise of any financial
difficulty and have made no payments, I am beginning to believe that you are refusing
payment of this invoice,
While I try not to make it my practice to begin legal collection proceedings
against my clients with regard to outstanding invoices, my business is such that I am not
able to sustain such a large financial loss, I am forwarding this letter as a courtesy to
provide you a final opportunity to either begin making payments, or contact rne to discuss
objections you rnay have to this bill. Should I fail to receive a payment or contact from
you within ten (10) days hereof, I will be left with no further options but to begin
collection proceedings,
It is my sincere hope that this letter serves only as a final reminder and does not
initiate any adversarial proceedings, It is not rny intention to complicate your life or
cause you additional problems, Please understand that your outstanding invoice
represents significant time and expense spent on your behalf. Until now, I had no doubt
of your integrity or reasonableness, I hope with this letter you will remove those doubts.
