Be it known, that on the 29th day of July, 2005, before me, the subscriber, a Notary Public,
personally appeared MARK E. HALBRUNER, who, being duly sworn according to law, did depose
and state as follows:
1. I am an attorney licensed to practice law in Pennsylvania and employed by the law
firm of Gates, Halbruner & Hatch, P.C., which has its main office at 1013 Mumma Road, Suite 100,
Lemoyne, Pennsylvania 17043.
2. I represent David A. Prosser, petitioner in the above-captioned matter.
3. On May 18, 2005, I telephoned Jane Adams, Esquire, court-appointed counsel for
Daniel W. Prosser, the alleged incapacitated person, to confirm that she had received the petition and
citation in this matter.
4. On May 18, 2005, I faxed the petition and citation to the medical office at York
County Nursing Home, where Daniel W. Prosser currently resides, and I mailed copies of the petition
and citation to Wanda Morgan, the guardianship liaison at York County Nursing Home.
5. On July 7,2005, I faxed the revised citation with the new hearing date to Attorney
Adams, and I mailed a copy of the revised citation to Wanda Morgan.
6. Service could not be made directly to Daniel W. Prosser due to his medical condition.
