Cowoski 6 Spring Valley Lane Mechanicsburg, P A 17055 DEFENDANTS COMPLAINT IN MORTGAGE FORECLOSURE Plaintiff, First Horizon Home Loan Corporation f/kla FT Mortgage Compies d/b/a MNC Mortgage, the address of which is, 4000 Horizon Way, Irving, TX 75063, brings this action of mortgage foreclosure upon the following cause of action: 1. Parties to Mortgage: Mortgagee: FT Mortgage Companies, d/b/a MNC Mortgage Mortgagor(s): Christopher 1. Cowoski and Jill A. Cowoski (b) Date of Mortgage: October 13, 1998 (c) Place and Date of Record of Mortgage: Recorder of Deeds Cumberland County Mortgage Book 1490 Page 534 Date: October 20, 1998 The Mortgage is a matter of public record and is incorporated herein as provided by Pa. RC.P. No, 10 19(9). A true and correct copy of the Mortgage is attached hereto and marked as Exhibit "A" and incorporated herein by reference, 2, Plaintiff is, therefore, either the original Mortgagee named in the Mortgage, the legal successor in interest to the original Mortgagee, or is the present holder of the mortgage by virtue ofthe above-described Assignment(s). 3, The real property which is subject to the Mortgage is generally known as 6 Spring Valley Lane, Mechanicsburg, Pa 17055 and is more specifically described as attached as part of Exhibit "A": 4, Each Mortgagor named in paragraph I executed a note as evidence ofthe debt secured by the Mortgage (the "Note"). A true and correct copy of the Note is attached and marked as Exhibit "8." 5, The name and mailing address of each Defendant is: Jill Cowoski aka Jill A. Cowoski, 6 Spring Valley Lane, Mechanicsburg, P A 17055; Christopher Cowoski aka Christopher J. Cowoski, 6 Spring Valley Lane, Mechanicsburg, PA ]7055 6, The interest of each individual Defendant is as Mortgagor, Real Owner, or both. 7. The Mortgage is in default because the monthly installments of principal and interest and other charges stated below, all as authorized by the Mortgage, are due as of February 1, 2005 and have not been paid, and upon failure to make such payments when due, the whole of the principal, together with charges specifically itemized below are immediately due and payable, 8, The following amounts are due as of Julv ]6,2005: Princioal of Mortgage debt due and unoaid $]05,937.78 Interest currently due and owing at 7% per annum calculated from January 1,2005 at $20.32 each day $4,003,04 Late Charge of $41.42 per month assessed on the 16th of each month from February ]6, 2005 to July 16,2005, (6 Months) $248.52 Escrow Balance ($529.90) SuspenselVnapplied Balance ($72.37) Accrued Late Charges $164.44 Title SearchlReport Fees $250,00 Attorneys' Fees and Costs $1,500,00 Mortgage Insurance Premium $85,92 TOTAL $111,587.47 9, Interest accrues at a per diem rate of 20.32 each day after July 16,2005 that the debt remains unpaid, and Plaintiff may incur additional attorneys' fees, as well as other expenses, costs and charges collectible under the Note and Mortgage, 10. The attorneys' fees set forth above are in conformity with the Mortgage documents and Pennsylvania law, and, will be collected in the event of a third party purchaser at Sheriffs sale, If the Mortgage is reinstated prior to the sale, reasonable attorneys' fees will be charged based on work actually performed. II. The original principal balance of the mortgage exceeds Fifty Thousand Dollars ($50,000) Accordingly, Notice of Intention to Foreclosure pursuant to 41 P,S, Statute 403 is not required, 12. The Mortgage is insured by the Federal Housing Administration under Title II of the National Housing Act (12 D.S.C. S 1707-1715z-18), Accordingly, the Homeowners' Emergency Assistance Act of 1983,35 P.S. S 1680.402c is not applicable. WHEREFORE, Plaintiff respectfully requests that this Court enter judgment in rem in favor of Plaintiff and against Defendants, jointly and severally, in the amount set forth in paragraphs 8 and 9, together with interest, attorneys' fees and for other expenses, costs, and charges collectible under the Note and Mortgage and for the foreclosure and sale of the mortgaged premises.
