COMPLAINT
AND NOW, comes the Plaintiff, Christine M. Maxwell, by and through her
attorneys, SCHMIDT, RONCA & KRAMER, P.C., and respectfully sets forth as
follows:
1. Plaintiff Christine M. Maxwell is an adult individual currently residing
at 926 Maplewood Lane, Enola, Cumberland County, Pennsylvania 17025.
2. Defendant Jordan Mustin is an adult individual currently residing at
863 Acri Road, Mechanicsburg, Cumberland County, Pennsylvania 17050.
3. The facts and events hereinafter stated took place on or about April 5,
2004 at 3:59 p.m., at the intersection of East Penn Drive and Magaro Road, in East
Pennsboro Township, Cumberland County, Pennsylvania.
4. At the aforementioned time and place, Plaintiff Christine M. Maxwell
was driving south on East Penn Drive and approaching the intersection of East
Penn Drive and Magaro Road, and had begun proceeding through the intersection.
5. At the aforementioned time and place, Defendant Jordan Mustin,
driving his vehicle was traveling north on East Penn Drive. He was in the left turn
lane at the intersection attempting to make a left onto Magaro Road.
6. The collision occurred when Defendant Jordan Mustin failed to observe
and yield to Plaintiff Christine M. Maxwell and collided with her vehicle.
7. The collision caused the injuries to the Plaintiff as set forth below.
COUNT I
CHRISTINE M. MAXWELL v. JORDAN MUSTIN
NEGLIGENCE
8. Paragraphs 1 through 7 of the Plaintiff's complaint are incorporated
herein by reference and made a part thereof as if set forth in full.
9. The accident was caused by the negligence and carelessness of
Defendant Jordan Mustin and was in no way caused or contributed to by Plaintiff
Christine M. Maxwell.
10. The negligence and carelessness of Defendant Jordan Mustin consisted
of the following:
a. inattentiveness;
b. distraction;
c. failing to have his vehicle under proper and adequate
control;
d. negligently applying the brakes;
e. failing to apply the brakes in time to avoid the collision;
f. failing to observe the vehicle driven by Christine M. Maxwell
lawfully on the roadway;
g. failing to operate the vehicle in accordance with existing traffic
conditions and traffic controls;
h. failing to keep a reasonable lookout for other vehicles lawfully on
the roadway;
1. operating his vehicle so as to create a dangerous situation for
other vehicles on the roadway;
k. attempting to turn when it was not safe to do so; and
1. failing to yield to vehicle with the right of way.
11. As a factual result of the accident, Plaintiff Christine M. Maxwell
suffered injuries which are severe and what are believed to be permanent, which
include the following:
a. neck pain;
b. right knee pain;
c. abrasion to right knee;
d. cervical strain;
e. dizziness;
f. nausea;
g. headaches;
h. persistent low back pain;
1. S 1 radiculopathy;
J. lower back musculoskeletal pain;
12. As a factual result of the accident, Plaintiff, Christine M. Maxwell,
has incurred medical expenses to date and will continue to incur medical expenses
into the future, and thus, a claim for these expenses are made.
13. As a factual result of the accident, Plaintiff Christine M. Maxwell avers
that the aforementioned injuries may be permanent in nature and effect and, thus,
a claim for these injuries is made.
14. As a factual result of the accident, Plaintiff Christine M. Maxwell has
undergone in the past, and will continue to undergo in the future, great pain and
suffering, and thus, a claim for these injuries is made.
15. As a factual result of the accident, Plaintiff Christine M. Maxwell has
been obliged to spend various sums of money and to incur various expenses for the
injuries that she has suffered and may continue to incur the same in the future,
and thus, a claim for these losses is made.
16. As a factual result of the accident, Plaintiff Christine M. Maxwell
suffered a loss of earnings and earning capacity, thus a claim for these losses is
made.
17. As a factual result of the accident, Plaintiff Christine M. Maxwell
suffered a permanent diminution of her ability to enjoy life and life's pleasures, and
thus, a claim for these losses is made.
WHEREFORE, Plaintiff Christine M. Maxwell demands judgment on
Defendant Jordan Mustin, in an amount in excess of an amount requiring
compulsory arbitration.
