STIPULATION AGAINST LIENS
THIS AGREEMENT made the v?)~ay of July, 2005, by and between,
RINE and RINE BUILDERS, INC., Builder, of Shipp ens burg, Pennsylvania, hereinafterreferred to
as Contractor,
AND
CHRISTOPHER D. GALLO, of 48 Holtry Road, Shippensburg, Pennsylvania, hereinafterreferred
to as Owner,
WHEREAS, the said Contractor undertook and agreed to make certain improvements to
Owner's property situate in Cumberland, Pennsylvania, known as Lot 3, with a post office address of
SO Holtry Road, situate in Shippensburg, Southampton Township, Cumberland County,
Pennsylvania, more fully described in Exhibit "A" attached hereto and made a part hereof.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration ofthe sum of One Dollar ($1 ,00) to said Contractor in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement
aforesaid, for himself, and his subcontractors, and all parties acting through or under them, covenant
and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them
against the said buildings and improvements and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of them under said contract or
otherwise, for, towards, in, or about the erection and construction of the said improvements on the lot
above described, and the said Contractor, for himself, his subcontractors and others under him
hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or
claims against the said buildings or any of them, and agree that this instrument, waiving the right of
lien, shall be an independent covenant.

ALL that certain tract of land known as Lot 3 in Southampton Township, Cumberland County,
Pennsylvania, bounded and described as follows:
BEGINNING along Township Road 325; thence along the same, South 66 degrees 22
minutes 20 seconds West 430.27 feet to a spike at corner of lands now or formerly of David L. Gallo
and Wanda L. Gallo, his wife; thence along lands of the same, North 47 degrees 00 minutes 20
seconds West, 238.80 feet to an iron pin along land now or formerly ofJohn Ebersole; thence along
lands of Ebersole, North 48 degrees 18 minutes 30 seconds East 237.57 feet to an iron pin in post
along land now or formerly of Smith; thence along lands now or formerly of Smith, South 69 degrees
14 minutes 10 seconds East, 418,65 feet to a point and place of BEGINNING.
CONTAINING 2, I 94 acres and being known as Lot No.3 on a draft of survey prepared by
Thomas Alvin Neff, R.S., dated March 1,1975 and revised on January 27, 1976 and recorded in the
Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 28 at
Page II 7.
