STIPULATION AGAINST LIENS

THIS AGREEMENT made this 22- -day of July, 2005, by and
between Neidlinger Construction ,---a sole proprietor, hereinafter
referred to as Contractor,
AND
Larry V. Neidlinger and Mary Jo Neidlinger, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in West Pennsboro Township, Cumberland County,
Commonweal th of Pennsylvania, and more fully described in Exhibit
"An which is attached hereto and made a part hereof known as Lot #5
Stonecrest Acres, Newville, PA 17241.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

On this, the day of July, 2005, before me, the
undersigned officer, personally appeared Larry V. Neidlinger, of
Neidlinger Construction, known to me (or satisfactorily proven)
to be the person whose name is subscribed to the within
instrument, and acknowledged that he executed the same for the
purposes therein contained.

ALL that certain lot of land sitnate in West Pennsboro Township, Cumberland County,
Pennsylvania, more particularly bounded and described as follows:
BEGINNING at a p.k. nail set on the centerline ofT-434 (also known as Green Hill Road) at
the dividing line of Lot No.5 herein conveyed and lot No.6 as shown on the hereinafter
mentioned Subdivision Plan; thence along said centerline North 02 degrees 04 minutes 24
seconds West, a distance of 129.47 feet to an existing railroad spike on the dividing line of
properties now or formerly of Darren R. and Wanda L. Bowers and now or formerly of
David P. and Sally A. Wagner; thence along said centerline North 01 degrees 42 minutes 25
seconds West a distance of 70.54 feet to a p.k. nail at the dividing line of Lot No.4; thence
along Lot No.4 North 88 degrees 17 minutes 35 seconds East passing through an iron pin
25.00 feet from beginning point, a distance of 463.00 feet to an iron pin at the dividing line
of Lot No. 20; thence along Lot No. 20 South 01 degree 42 minutes 25 seconds East, a
distance of 200.00 feet to an iron pin; at the dividing line of Lot No.6; thence along Lot No.
6 South 88 degrees 17 minutes 35 seconds West, a distance of 462.17 feet passing through an
iron pin 23.07 feet from end point, the place of BEGINNING.
CONTAINING a total area of 2.01266 acres and being Lot No.5 on a Land Subdivision for
Stonecrest Acres recorded in Cumberland County Plan Book 81, Page 124.
