LAST WILL AND TESTAMENT OF JOHN E. ROTH
I, JOHN E. ROTH, of the Village of Bowmansdale, Township
of Upper Allen, County of Cumberland and State of Pennsylvania,
being of sound and disposing mind, memory and understanding,
do make, publish and declare this my Last Will and Testament.
1.
I direct the payment of all my just debts and funeral
expenses as soon after my decease as the same can be conveniently
done.
2.
I give, devise and bequeath all the rest, residue and
remainder of my estate, of whatsoever nature and wheresoever
situate, to my wife, Louise H. Roth, her heirs and assigns,
absolutely and unconditionally.
3.
In the event that my said wife, Louise H. Roth, should
predecease me, or should she die at about the same time as I
do, such as in an accident common to both of us, then in such
event, I give, devise and bequeath my entire estate, of whatsoever
nature and wheresoever situate, to my son, Kerry L. Roth, his
heirs and assigns, absolutely and unconditionally.
Should my wife, Louise H. Roth, predecease me, or die
at about the same time as I do such as in a common disaster,
and should my son, Kerry L. Roth, also have predeceased me, then
in such event, I give and bequeath my entire estate to my
daughter-in-law, Denise Roth, and any grandohildren whioh I
may have at the time of my decease, share and share alike, it
being my intention that my said daughter-in-law and grandchildren

each receive an equal share in my estate, and in this respect
also, for the purpose of facilitating the settlement and just
distribution of my estate, I authorize and empower my Executrix
hereinafter named, to sell any and all real estate which I may
own at the time of my decease, at either public or private sale
or sales.
LASTLY, I nominate, constitute and appoint my wife, Louise
H. Roth, Executrix of this my last Will and Testament, and in the
event that my said wife should predecease me, or should she be
unable or unwilling to serve in such capacity for any reason, then
in such event, I nominate, constitute and appoint my son, Kerry L.
Roth, Executor of this my last Will and Testament in her pIece and
stead, and should both my wife, Louise H. Roth and my son, Kerry
L. Roth, predecease me, or should they be unable to serve as my
personal representative for any reason, then in such event, I
nominate, constitute and appoint my daughter-in-law, Denise
Roth, Executrix of this my last Will and Testament, in their place
and stead.
IN WITNESS WHEREOF, I have hereunto set my hand and seal
