STIPUAL TION AGAINST LIENS
THIS AGREEMENT made the 5"" day of ~WI zWS , by and between
ROBERT COLDSMITH GENERAL CONSTRUCTION, 137 Pine Tree
Drive, Pennsylvania 17241
Hereinafter referred to as Contractor,
AND
GARY W. SHULENBERGER & KRISTlNE K. SHULENBERGER, Lot #4
Greenhill Road Newville, Pennsylvania 17241, hereinafterreferred to as Owner, whereby
the former undertook and agreed to erect and construct a
SINGLE F AMIL Y DWELLING on that certain lot of ground situate in
Lot #4 Greenhill Road, Newville West Pennsboro Township, Cumberland County,
Pennsylvania. (SEE ATTACHED LEGAL DESCRIPTION)
NOW THEREFORE, THIS AGREEMENT WITNESSTH: That the said Contractor,
for and in consideration of the sum of ($1.00) Dollar to ROBERT COLDSMITH
GENERAL CONSTRUCTION in hand paid by Owner, the receipt whereof is hereby
acknowledged, and further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and all parties acting through or under them,
covenant and agree that no mechanics liens or claims shall be filed or maintained by them
or any of them against the said buildings and the lot of ground appurtenant thereto for or
on account of any work done or materials furnished by them or any of them under said
contract or otherwise, for, towards, in, or about the erection and construction of the said
buildings on the lot above the said Contractor, for themselves, their subcontractors and
others under them hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings or any of them, and
agree that this instrument, waiving the right oflien, shall be an independent covenant

ALL that certain tract of land situate in West Pennsboro Township, Cumberland County, Pennsylvania, bounded
and described as follows, to wit:
BEGINNING at a railroad spike set in the centerline of Township Road 435 (Wagners Lane) at corners common
with Lot NO.2 of the within referenced Subdivision Plan; thence, along said Lot No, 2 North 36 degrees 39
minutes 20 seconds West a distance of 337,34 feet throuhg a concrete monument set 25 feet from the said
centerline to an iron pin at corners common with said Lot No, 2; thence along Lot No, 3 of the within referenced
Subdivision Plan North 53 degrees 01 minutes 17 seconds East a distance of 203,4 1 feet to an iron pin; thence
along lands now or formerly of Walter M, and Virginia J, Fickes South 88 degrees 05 minutes 06 seconds East
East a distance of 41 ,56 feet to an iron pin; thence along same South 51 degrees 31 minutes 06 seconds East a
distance of 323,40 feet through a concrete monument set 25 feet from the centerline of Township Road 435
(Wagners Lane) to a railroad spike set in the centerline of said Township Road; thence along the said centerlin
South 53 degrees 20 minutes 40 seconds West a distance of 318.85 feet to a railroad spike, being the place of
BEGINNING,
BEING all of Lot No, 4 of the Subdivision Plan for David Wagner prepared by john R. Kissinger, Surveyor, dated
October 15, 1999 and recorded in the office of the Recorder of Deeds in Plan Book 84, Page 139.
