GEIGER SR., prior to his death, had executed a LAST WILL AND TESTAMENT dated June 19, 1999, which was duly admitted to probate by the Register of Wills of Cumberland County at File Number 21 - 05 - 0300 on March 31, 2005, and Letters Testamentary were granted thereon to Edwin W. Geiger Jr., Executor; and WHEREAS, DOLORES M. ZEHRING, EDWIN W. GEIGER JR., and ROBERT L. GEIGER are entitled to their respective shares of the residuary estate after the payment of all debts and expenses; and WHEREAS, it is the desire of the parties to this Agreement that a final distribution and settlement of the Estate be accomplished without a formal accounting to the Orphan's Court Division of the Court of Common Pleas of Cumberland County, it being their desire to avoid the expense, delay and publicity of a formal accounting. NOW THEREFORE, in consideration of the mutual promises, covenants and agreements recited herein, the parties to this Agreement do agree as follows: 1. Each of the parties to this Agreement does hereby release and forever discharge the other from any and all liability which may, from time to time, arise in connection with the services of Edwin W. Geiger Jr., as Executor of Estate of Edwin W. Geiger Sr., and they do further indemnify and hold each other harmless from any and all additional liabilities which may arise against them or against the Estate from creditors or other claimants. -1- .. .
