Cashman files this Petition for Citation addressed to Rick A. Cashman, Michele L. Cashman and Angela J. Cashman to appear and show cause, if any there be, why Letters of Administration in the Estate of Doris A. Cashman, deceased, should not be granted solely to Petitioner, Glenn E. Cashman: 1. Decedent, Doris A. Cashman, died on February 7,2005, a resident of 114 Center Street, Enola, East Pennsboro Township, Cumberland County, Pennsylvania. 2. On or about August 18,2005, Petitioner lodged with the Register of Wills of Cumberland County the necessary petitions and paperwork for probate for the grant of Letters of Administration. .,~ I c...) ; ~ r.......' Cashman died unmarried and survived by two sons, namely, Glenn E. Cashman of949 Wertzville Road, Enola, Cumberland County, Pennsylvania and Rick A. Cashman, currently incarcerated at the Augusta Correctional Center, P. O. Box 1000, Craigsville, Virginia 24430. Dale Cashman, a third son, predeceased the decedent and left two daughters, namely, Michele 1. Cashman and Angela J. Cashman, currently residing at Box 184, Bazine, Kansas 67516. 4. The Register of Wills determines whether or not letters of administration will be granted, and if so to whom, primarily on the bases of the statutory preferences and of his/her examination of the petition submitted to hirn/her by the party or parties seeking letters. 5. As there is no surviving spouse, according to the Probate, Estates and Fiduciaries Code, Section 3153, Letters of Administration are to be granted to those who are entitled under the intestate laws and who the Register, in his/her discretion, shall judge will best administer the estate. Preference is given according to the sizes of the shares of those in this class. 6. Glenn E. Cashman is entitled to administer the Estate because I) Rick A. Cashman is unavailable, incarcerated in Virginia and has refused to respond to any correspondence regarding his qualifications/renunciation as Administrator; and 2) Michele 1. Cashman and Angela J. Cashman are residents of Kansas and are entitled to a smaller share of the net distributable estate. Furthermore, Section 3156 of the PEF Code states the Register in his/her discretion may refuse Letters of Administration to nonresidents of Pennsylvania. 7. Petitioner requests that probate be completed and Letters of Administration be issued so that estate administration may be commenced. WHEREFORE, Petitioner requests that Your Honorable Register of Wills issue a citation directed to Rick A. Cashman, Michele L. Cashman and Angela J. Cashman to appear and show cause, if any there be, why Letters of Administration in the Estate of Doris A. Cashman, deceased, should not be granted solely to Glenn E. Cashman. 17068 VERIFICATION I, GLENN E. CASHMAN, verify that the statements made in this Petition for Citation to Show Cause Why Letters of Administration should not be Granted Solely to Glenn E.
