O:J~~. "idJ0 ~ Jc.;v- v. SHIRLEY A. BARRICK, Defendants. ACTION IN REPLEVIN COMPLAINT NOW COMES the Plaintiff, Jerome G. Brownawell, by and through his Attorneys, Stephanie E. Chertok and Andrew H. Shaw, and files the instant Complaint, and in support thereof state as follows: l. Plaintiff is an adult individual residing at 196 Shed Road, Carlisle, Cumberland County, Pennsylvania. 2. Defendant is an adult individual residing at J28 Darr Avenue, Carlisle, Cumberland County, Pennsylvania. 3. Prior to August 6, 2005, Plaintiff and Defendant lived together. 4. On or about August 6, 2005, Defendant kicked Plaintiff out of the residence and has refused to permit Plaintiff to retrieve his belongings. 5. On August 5, 2005, Plaintiff and Defendant, through Plaintiff's counsel, arranged that Plaintiff could retrieve his belongings on August 6, 2005 at I :30 p.m. by picking up his items at the end of Defendant's driveway. 6. It was agreed that Defendant would carry Plaintiff's belongings to the end of the driveway. 7. On August 6, 2005 at 1 :30 p.m., Plaintiff appeared at the residence, but Defendant had tailed to set Plaintiff's belongings at the end of the driveway. 8. The following items of Plaintiffs personal property are being held by Defendant: a) 1993 Kawasaki motorcycle worth approximately $3.000.00; b) 2001 Kawasaki motorcycle worth approximately $7,000.00; c) 32" color television worth approximately $250.00; d) Leather jacket worth approximately $200.00; e) Leather chaps worth approximately $200.00; f) Various articles of clothing, including but not limited to shirts, pants, boots, shoes, socks, underpants; g) Motorcycle helmet; and h) Hunting coveralls. 9. Plaintiff believes and therefore avers that the above-mentioned items of personal property are still located at Defendant's residence. 10. All of the above-mentioned items are owned solely by Plaintiff. 1 1. Plaintiff has asked, and Defendant has refused to permit Plaintiff to retrieve the above- mentioned items ofpersonaJ property. 12. Because Plaintiff has not had access to the above-identified property since August 6, 2005, he cannot confirm if Defendant has disposed of said property. 13. If Defendant has disposed of any of the above-identified property, Plaintiff seeks recovery of the fair market value of said property. WHEREFORE, Plaintiffs prays this Honorable Court order that Plaintiff be permitted to retrieve the items of personal property identified above, together with costs, attorney's fees, interest, and any other relief this Court deems appropriate. In the alternative, Plaintiff prays this Honorable Court award plaintiff the fair market value of the personal property, together with costs, attorney's fees. interest, and any other relief this Court deems appropriate.
