COMPLAINT
Plaintiff, Members I' Federal Credit Union (Members 1), by its attorneys, Saidis, Shuff,
Flower & Lindsay, P.C., files this Complaint demanding payment for outstanding amounts due
under a motor vehicle installment sales contract and under a closed-end note, alleging in support
thereof the following:
1. Members I" is a credit union, organized and existing under the Federal Credit
Union Act, with a principal office located at 5000 Louise Drive, Mechanicsburg, Pennsylvania
17055..
1 Defendant William S. Miller is an adult individual having a last known address of
1329 English Drive, Mechanicsburg, Cumberland County, Pennsylvania 17055.
Count I
Motor Vehicle Installment Sale Contract
3. On or about April 3, 2003, Defendant obtained a loan from Members I" in the
original principal amount of $40,000.00 (the "Vehicle Loan"), as evidenced by a Motor Vehicle
Installment Sale Contract (the "Contract'), a copy of which is attached hereto as Exhibit "A" and
incorporated herein by reference.
4. Under the terms and conditions of the Contract, Defendant agreed to repay the
principal balance of the Contract, together with interest at the annual percentage rate of 6.49% by
way of regular monthly payments of principal and interest in the amount of $664.82 each, to
commence on June 14, 2003, with the full outstanding balance of the Loan together with interest
thereon due on or before May 14, 2009.
5. Defendant is in default of his obligation to make payment of the amounts due to
Members 1 st under the Contract, for, inter alia, failure to make the monthly payments due Members
1 st under the terms and conditions of the Contract.
6. Notice of the default, repossession of the motor vehicle which was the subject of the
Contract, and demand and opportunity to cure the same, required under the Uniform Commercial
Code, were provided to the Defendant on or about December 16, 2003, a copy of which is attached
hereto as Exhibit "B" and incorporated herein by reference.
7. As a result of Defendant's defaults, Members 1st exercised its rights and remedies
under the Contact and the UCC and disposed of the repossessed motor vehicle, and on January 28,
2004, notified the Defendant of its disposition, and demanded immediate payment of all of the
remaining amounts due under the Contract, a copy of which is attached hereto as Exhibit "C" and
incorporate herein by reference.
8. The amounts due to Members 15C under the Contract as a result of Defendant's
defaults as of September 3, 2004, is $15,584.43 itemized as follows:
a. Principal $ 14,191.97
b. Interest as of September 3, 2004 $ 549.36 plus $2.52 per ahem
c. Late Charges as of August 25
d. Attorneys' Fees and Costs
e. Total Due
$ 93.10 plus $13.30 per month
$ 750.00
$ 15,584.43
9. Defendant also agreed under the terms of the Contract that in the event of default
thereunder Defendant would pay, in addition to the charges listed in paragraph 8 above, all
reasonable costs, fees and expenses incurred by Members 1st as a result of the institution of these
legal proceedings.
10. Despite Plaintiff s demands, Defendant has failed and continues to fail to make
payments of all amounts due to Members I st under the terms and conditions of the Contract.
Count II
Closed End Note
11. On or about October 1, 2002, Defendant obtained a loan from Members I' in the
original principal amount of $3,000.00 (the "Signature Loan"), as evidenced by a Closed End Note,
Disclosure, Loan and Security Agreement (the "Note"), a copy of which is attached hereto as
Exhibit "D" and incorporated herein by reference.
12. Under the terms and conditions of the Note, Defendant agreed to repay the principal
balance of the Note, together with interest at the annual percentage rate of 11.75% by way of regular
monthly payments of principal and interest in the amount of $99.78 each, to commence on
November 16, 2002, with the full outstanding balance of the Loan together with interest thereon due
on or before October 16, 2005.
13. Defendant is in default of his obligation to make payment of the amounts due to
Members 1 st under the Note, for, inter atia, failure to make the monthly payments due Members 1 st
under the terns and conditions of the Note.
14. Notice of the default, acceleration of the entire balance due under the Note, and
demand for payment of the same, were provided to the Defendant on or about May 6, 2004, a copy
of which is attached hereto as Exhibit "E" and incorporated herein by reference.
15. The amounts due to Members I" under the Note as a result of Defendant's defaults
as of September 3, 2004, is $15,584.43 itemized as follows:

c. Attorneys' Fees and Costs
d. Total Due

16. Defendant also agreed under the terms of the Contract that in the event of default
thereunder Defendant would pay, in addition to the charges listed in paragraph 15 above, all
reasonable costs, fees and expenses incurred by Members 1st as a result of the institution of these
legal proceedings.
17. Despite Plaintiffs demands, Defendant has failed and continues to fail to make
payments of all amounts due to Members 1st under the terms and conditions of the Contract.
WHEREFORE, Plaintiff, Members I" Federal Credit Union, demands judgment against
Defendant, William S. Miller, in the amount of $18,092.25, plus interest at the rate of $3.20 per day,
from September 4, 2004, through the date of Judgment entered hereon and thereafter through the
date of payment, including on and after the date of entry of judgment on this Complaint, and legal
fees and costs.
