COMPLAINT
I, The Plaintiff is the New Cumberland Federal Credit Union with a principal place of
business located at 345 Lewisberry Road, New Cumberland, York County,
Pennsylvania 17070, Plaintiff is a federally chartered non profit credit union,
2. The Defendant Maeng C. Johnson is an adult individual residing at Apartment 6,
2109 Princeton Avenue, Camp Hill, Cumberland County, Pennsylvania 1701 I.
3, The Defendant Walter 1. Johnson is an adult individual residing at 1527-1 Logan
Street, Harrisburg, Dauphin County, Pennsylvania 17102.
4. The parties are not current members ofthe Armed Forces and are married.
COUNT I: 2000 PROMISSORY NOTE
5, On June 3, 2000 Defendants executed a Promissory Note attached as Exhibit "A" in
the amount of Eighteen Thousand Five Hundred Thirty and 54/100 ($18,530.54)
Dollars at 11.99% interest and pledged as collateral a 1997 Jeep Cherokee.
Defendant Maeng C, Johnson was the borrower and Defendant Walter 1. Johnson
was to co-borrower under this Promissory Note.
6. The terms of Exhibit "A" required timely payments of $419.59 each month,
Defendants failed to make timely payments and the Jeep Cherokee was repossessed
and sold with a balance remaining due of Four Thousand Seven Hundred Thirty Nine
and 15/100 ($4,739.15) Dollars at 11.99% interest as of August 1,2005.
7. Defendants have made no regular payments despite repeated requests.
8. Pursuant to each Promissory Note the Defendants agreed to pay all "court costs and
reasonable attorney fee" incurred in any collection action.
WHEREFORE, Plaintiff respectfully requests entry of judgment in the amount
of$4,739.15 at 11.99% interest from August 1,2005 together with all court costs
and an award of reasonable attorneys' fees,
COUNT II: 2001 PROMISSORY NOTE
9, On June 2, 2001 Defendants executed a Promissory Note attached as Exhibit "B" in
the amount of Twenty Eight Thousand Two Hundred Twenty Four and 41/100
($28,224.41) Dollars at 16.99% interest and pledged as collateral a 2000 Mitsubishi
Montero. Defendant Maeng C. Johnson was the borrower and Defendant Walter L.
Johnson was to co-borrower under this Promissory Note.
10. The terms of Exhibit "B" required timely payments of $628.88 each month,
Defendants failed to make timely payments and the Jeep Cherokee was repossessed
and sold with a balance remaining due of Six Thousand Seven Hundred Fourteen and
811100 ($6,714,81) Dollars at 16,99% interest as of August 1, 2005,
11. Defendants have made no regular payments despite repeated requests.
12, Pursuant to each Promissory Note the Defendants agreed to pay all "court costs and
reasonable attorney fee" incurred in any collection action.
WHEREFORE, Plaintiff respectfully requests entry of judgment in the amount
of$6,714.81 at 16.99% interest from August 1, 2005 together with all court costs
and an award of reasonable attorneys' fees.
