Real Estate - All that certain piece or parcel of real estate having erected thereon a
dwelling house being known and numbered as 15 North High Street,
Shiremanstown, Pennsylvania. The property was acquired by Charles G. Klinger
and Mary Elizabeth Klinger, husband and wife, by Deed dated March 30, 1954 and
recorded in the Cumberland County Recorder of Deeds Office, a copy of said Deed
being attached hereto and incorporated herein. The said Elizabeth Klinger died
July 7,1991, whereupon full and complete title became vested solely in Charles G.
Klinger, the Decedent herein. The above-described real estate was sold pursuant to
an Agreement of Sale for Real Estate dated July 7, 2005, a copy of which is attached
hereto and incorporated herein. Final settlement took place on August 26, 2005. A
copy of the Deed conveying said real estate, along with a copy of the Settlement
Sheet, are attached hereto and incorporated herein. The sale price of the real estate
was $119,500.00.

THIS IS AN AMENDMENT to a certain Standard Agreement for the Sale of
Real Estate dated as of July 7, 2005, by and between The Estate of Charles G.
Klinger ("Seller") and Chris Turnpaugh, Scott Copeland, and George Dubniczki

Pennsylvania, by their Deed dated March 30, 1954, recorded March 30, 1954, in the Office of
the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Deed Book 15R, Page

title unto Charles G. Klinger, her husband and;

WHEREAS, the Register of Wills for Cumberland County, Pennsylvania, duly granted
Letters of Testamentary to James W. Klinger, Grantor herein, on January 7,2005 ,
thereby granting him authority to grant and convey said premises pursuant to Section
3351 of the Pennsylvania Probate, Estate and Fiduciary Code (20 Pa.C.s.A. 3351).
Now This }ndellture Witnesseth, That the said Grantor for and in consideration of the sum of
One Hundred Nineteen Thousand Five Hundred & 00/100 Dollars ($119,500.00)
lawful money of the United States of America, unto him well and truly paid by the said Grantee
at and before the sealing and delivery hereof, the receipt whereof is hereby acknowledged,
granted, bargained, sold, aliened, released and confirmed, and by these presents do grant,
bargain, sell, alien, enfeojJ. release and confirm unto the said Grantee, heirs and assigns.
ALL THA T CER T AIN tract of land situate in the Borough of Shiremanstown, County of
Cumberlalld and State of Pennsylvania. more particularly bounded and described as follows, to

BEGINNING at a point on the eastern line of High Street, which point isfifty (50~feet south of
the southeast comer of the intersection of said High Street and Front Street; thence in an
eastern direction a distance of one hundredfifty (I50~feet, more or less, to a point in the line of

all the estate, right, title, interest, use, trust, property, possession, claim and demand whatsoever,
of the said, as and immediately before the time of decease, in law, equity, or otherwise
howsoever, of. in, to, or out of the same:
To have and to hold the said parcel above described with improvements thereon
hereditaments and premises hereby granted and released, or mentioned and intended so to be,
with the appurtenances, unto the said Grantee, the heirs and assigns to and for the only proper

I, CHARLES G. KLINGER, of the Borough of Shiremanstown,
Cumberland County, Pennsylvania, make, pUblish and declare this as
and for my Last Will and Testament, hereby revoking all other
Wills and Codicils heretofore made by me.
FIRST: I give and bequeath my household furniture and
furnishings, my personal effects, j~welry, clothing, automobiles
and all other tangible personal property, including all insurance
policies covering those items, to my wife, MARY E. KLINGER,
provided she survives me by sixty (60) days; or, if she does not
so survive me, to my children who survive me, to be divided
between or among them equally as they may agree.
SECOND: I devise and bequeath all the rest, residue and
remainder of my estate of whatever nature and wherever situate,
together with any insurance policies thereon, unto my wife, MARY
E. KLINGER, provided she survives me by sixty (60) days.
THIRD: Should my wife, Mary E. Klinger, predecease me
or die on or before the sixty-first (61st) day following my death,
I devise and bequeath all the rest, residue and remainder of my
\ estate of whatever nature and wherever situate, together with any

nsurance policies thereon, in equal shares, to my children, JOHN
F. KLINGER, JAMES W. KLINGER and JEFFREY A. KLINGER, or their
per stirpes.
FOURTH: In addition to all powers granted to them by
law and by other provisions of this Will, I give the fiduciaries
acting hereunder the following powers, applicable to all property,
exercisable without court approval and effective until actual
distribution of all property:
(A) To sell at public or private sale, or to lease, for
any period of time, any real or personal property and to give
options for sales, exchanges or leases, for such prices and upon
such terms (including credit, with or without security) or

conditions as are deemed proper. This includes the power to give
legally sufficient instruments for transfer of the property and to
receive the proceeds of any disposition of it.
(B) To partition, subdivide, or improve real estate and
to enter into agreements concerning the partition, subdivision,
improvement, zoning or management of real estate and to impose or
extinguish restrictions on real estate.
(e) To compromise any claim or controversy and to
abandon any property which is of little or no value.
(D) To invest in all forms of property, including
stocks, common trust funds and mortgage investment funds, without
restriction to investments authorized for Pennsylvania fiduci-
aries, as are deemed proper, without regard to any principle of
diversification, risk or productivity.
(E) To exercise any option, right or privilege granted
in insurance policies or in other investments.
(F) To exercise any election or privilege given by the
Federal and other tax laws, including, but not necessarily being
limited to, personal income, gift and estate or inheritance tax
laws.
(G) To make distributions to my herein named benefici-
aries in cash or in kind or partly in each.
(H) To borrow money from themselves or others in order
to pay debts, taxes, or estate or trust administration expenses,
to protect or improve any property held under my will, and for
investment purposes.
(I) To ~elect a mode of payment under any qualified
retirement plan (pension plan, profit sharing plan, employee stock
ownership plan, or any other type of qualified plan) to the extent
the plan or the law permits them to do so, and to exercise any
other rights which they may have under the plan, in whatever
manner they consider advisable.
FIFTH: I direct that all inheritance, estate, transfer,
succession and death taxes, of any kind whatsoever, which may be

payable by reason of my death, whether or not with respect to
property passing under this Will, shall be paid out of the princi-
pal of my residuary estate.
SIXTH: All interests hereunder, whether principal or
income, which are undistributed and in the possession of the
fiduciaries acting hereunder, even though vested or distributable,
shall not be subject to attachment, execution or sequestration for
any debt, contract, obligation or liability of any beneficiary,
and furthermore, shall not be subject to pledge, assignment,
conveyance or anticipation.
SEVENTH: I nominate and appoint my wife, MARY E.
KLINGER, Executrix of this, my Last Will and Testament. In the
event of the death, resignation or inability to serve for any
reason whatsoever of the said Mary E. Klinger, I nominate and
appoint my son, JOHN F. KLINGER, Executor of this, my Last Will
and Testament. In the event of the death, resignation or
inability to serve for any reason whatsoever of the said John F.
Klinger, I nominate and appoint my son, JAMES W. KLINGER, Executor
of this, my Last Will and Testament. In the event of the death,
resignation or inability to serve for any reason whatsoever of the
said James W. Klinger, I nominate and appoint my son, JEFFREY A.
KLINGER, Executor of this, my Last Will and Testament. I direct
that my Executor or Executrix, as the case may be, and their
successors, shall not be required to post security or a bond for
the performance of their duties in any jurisdiction.

Real Estate - All that certain piece or parcel of real estate having erected
thereon a dwelling house being known and numbered as 15 North High Street,
Shiremanstown, Pennsylvania. The property was acquired by Charles G.
Klinger and Mary Elizabeth Klinger, husband and wife, by Deed dated March
30, 1954 and recorded in the Cumberland County Recorder of Deeds Office, a
copy of said Deed being attached hereto and incorporated herein. The said
Elizabeth Klinger died July 7, 1991, whereupon full and complete title became
vested solely in Charles G. Klinger, the Decedent herein. The above-described
real estate was sold pursuant to an Agreement of Sale for Real Estate dated
July 7, 2005, a copy of which is attached hereto and incorporated herein. Final
settlement took place on August 26, 2005. A copy of the Deed conveying said
real estate, along with a copy of the Settlement Sheet, are attached hereto and
incorporated herein. The sale price of the real estate was $119,500.00.
