suspending petitioner's operating privilege, and in support thereof represents as follows:

Transportation of the entry of order suspending his driver's license (or operating privilege) for the

chemical testing upon arrest for driving while under the influence of alcohol or a controlled substance; or
accumulation of points). A copy of the notice (or ordel) is attached as Exhibit "A."
4. The suspension is improper and unlawful for the following reasons: (e.g.,
the arresting officer lacked reasonable grounds to believe that petitioner had been driving while under the
influence of alcohol; or the arresting officer failed to inform the petitioner that his operating privilege would
be suspended upon refusal to submit to chemical testing; or the petitioner's temporary inability to make a
decision whether or not to submit to chemical testing at the time did not constitute a refusal, when
petitioner ultimately consented to testing; the Department of Transportation failed to give timely notice of
suspension as a result of the accumulation of points in accordance with 75 Pa. Cons. Stat. Ann. ~ 1551;
etc.)
WHEREFORE, petitioner respect1ully requests that the Court set this matter down forthwith for de
novo hearing pursuant to 75 Pa. Cons. Stat. Ann. ~ 1550 and that the order of the Department of
Transportation be set aside.

AND NOW, this 13th day of September, 2005, upon consideration of
Petitioner's "Petition for Suspension Ref Driving License," and it being unclear
whether the person who filed the petition on behalf of Petitioner, Terry Spradley,
is an attorney and what the grounds for the appeal are, it is ordered and directed as
follows:
I. Within 20 days of the date of this order Petitioner shall
file in the prothonotary's office a supplement to the petition
containing a statement as to the grounds for the appeal and a
verification, signed by Petitioner, verifying the contents of the
petition as supplemented;
2. Within 20 days of the date of this order Terry Spradley
shall file in the prothonotary's office evidence of his or her
entitlement to practice law in the Commonwealth in the form

Petitioner Karon 1. Wallace, by the undersigned counsel, respectfully petitions
the Court pursuant to 75 Pa. Cons. Stat. Ann. 9 1550 for review of an order of the
Department of Transportation suspending petitioner's operating privilege, and in support
thereof represents as follows:
I. Petitioner Karon Wallace originally filed this Petition on September 2, 2005,
requesting that an Order of the Pennsylvania Department of Transportation be set aside.
2. On September 13, 2005 this Court issued an Order directing that supplemental
information be submitted in support ofthis Petition, along with proof of the admission of
Petitioner's representative into the Bar of Pennsylvania.
3. Petitioner Karon T. Wallace is an adult individual residing at 326 S. 14th Street,
Harrisburg, Pennsylvania.
4. Petitioner currently possesses a valid driver's license issued to him on October
5, 1998, which has not heretofore been suspended, cancelled, or revoked.
5. By letter dated August 12,2005, petitioner was notified in writing the
Department of Transportation of the entry of an order suspending his driver's licensee or
operating privilege) for the following reasons as set forth in the notice: 1543A. A copy
of the notice is attached as Exhibit "A."
6. The suspension is improper and unlawful for the following reasons:
Petitioner's driver's license was previously suspended. At the expiration of that period of
suspension, Petitioner was eligible for reinstatement of his license with the payment of a
twenty-five dollar ($25) restoration fee. After the expiration of the initial suspension
period, and before his payment of the $25.00 fee, Petitioner was ticketed for driving
without a valid license and his license was again suspended. Notwithstanding "personal
reasons" for which Petitioner was driving on this single occasion without a valid license,
Petitioner acknowledges that his driving before payment of the restoration fee and after
suspension was improper. However, Petitioner hereby appeals the decision to suspend
his license on the grounds that the penalty is inappropriate for the infraction that he has
committed.
WHEREFORE, Petitioner respectfully requests that the Court set this matter
down forthwith for de novo hearing pursuant to 75 Pa. Cons. Stat. Ann. S 1550 and that
the order of the Department of Transportation be set aside.

Dear Attorney Hicks:
I am writing to you regarding the above-mentioned appeal.
By official notice dated August 17,2005, the Department notified Karon Tya
Wallace, O.L.N. 26156230, that as a result of his August 8, 2005, conviction of violating
Section 1543A of the Vehicle Code, relating to Driving While Suspended, on May 28,
2005, his driving privilege was suspended for I year effective August 17,2005.
A "Petition for Suspension Ref Driving License," was filed on or about
September 7, 2005, which was signed by Terry Spradley.
By order dated September 13, 2005, the court issued the following order:
AND NOW, this 13th day of September, 2005, upon consideration
of Petitioner's "Petition for Suspension Ref Driving License," and it being
unclear whether the person who filed the petition on behalf of Petitioner,
Terry Spradley, is an attorney and what the grounds for the appeal are, it is
ordered and directed as follows:

Within 20 days of the date of this order Petitioner shall file in
the prothonotary's office a supplement to petition containing a
statement as to the grounds for the appeal and a verification,
signed by Petitioner, verifYing the contents of the petition as
supplemented;
Within 20 days of the date of this order Terry Spradley shall file
in the prothonotary's office evidence of his or her entitlement to
practice law in the Commonwealth of Pennsylvania in the form
of his or her Attorney's Number; and
In the event that either paragraph I or paragraph 2 of this order
are not complied with in the said 20-day period, Petitioner's
petition shall be deemed automatically dismissed without

further order of court; ifboth paragraphs are complied with, a
hearing on Petitioner's petition will be held on Thursday,
December 22, 2005, at I :30 p.m. in Courtroom No.1,

I am in receipt of your "Supplement to the Petition for Suspension Ref Driving
License," dated September 30, 2005, which also contained your Praecipe to Enter
Appearance, and a Verification. I am assuming that the Supplement was filed in response
to requirement Number I of the Order of Court dated September 13, 2005.
I am not in receipt of any document filed by Terry Spradley in the prothonotary's
office evidencing his or her entitlement to practice law in the Commonwealth of
Pennsylvania in the form of his or her Attorney's Number.
The Order of September 13, 2005, was very specific in setting forth two
requirements and that if either of them was not complied with within 20 days of the
Order, then the appeal was deemed automatically dismissed without further order of
court. Both requirements of the Order of September 13, 2005, have not been complied
with.
Please be advised that I am taking the appeal to be dismissed because the Order of
September 13, 2005, states that the appeal will be deemed automatically dismissed
without further notice of court ifhas not been complied with as set forth in the Order.
Additionally, in your appeal you set forth your reason for appeal as the following:
"Petitioner's driver's license was previously suspended. At the expiration
of that period of suspension, Petitioner was eligible for reinstatement of
his license with the payment of a twenty-five dollar ($25) restoration fee.
After the expiration of the initial suspension period, and before his
payment of the $25.00 fee, Petitioner was ticketed for driving without a
valid license and his license was again suspended. Notwithstanding
"personal reasons" for which Petitioner was driving on this single
occasion without a valid license, Petitioner acknowledges that his driving
before payment of the restoration fee and after suspension was improper.
However, Petitioner hereby appeals the decision to suspend his license on
the grounds that the penalty is inappropriate for the infraction that he has
committed.
Please be advised such reason as you mention in the Supplement has been
addressed recently in the case of Rossie v. Department o/Transportation, BDL, 860 A.2d
64 (Pa. 2004). In Rossie the petitioner argued that she should avoid the suspension
because she had served the term of suspension, was eligible to restore, but had not paid
the restoration fee. The Court upheld the Department's suspension of Rossie's operating
privilege and reaffirmed the principle that a person remains suspended until he or she
complies with all the steps necessary for restoration, including the payment ofthe
restoration fee.
Once again, based upon the Order of Court dated September 13, 2005, 1 am
deeming the appeal dismissed. I will consider the appeal dismissed unless I receive an
order from the court stating that the matter is not dismissed and that it is scheduled for
hearing.
