If the Court finds you to be an Incapacitated Person, your rights will be affected, including our right to manage money and property and to make decisions. A copy of the petition which has been filed by ANTHONY L. DELUCA, ESO. is attached. You are hereby ordered to appear at a hearing to be held in Court Room No. 1 , Cumberland County Courthouse, Carlisle, Pennsylvania, on AUGUST 8 , 200L, at 1:30 P.M. to tell the Court why it should not find you to be an Incapacitated Person and appoint a Guardian to act on your behalf. To be an Incapacitated Person means that you are not able to receive and effectively evaluate information and communicate decisions and that you are unable to manage your money and/or other property I or to make necessary decisions about where you will live, what medical care you will get, or how your money will be spent. At the hearing, you have the right to appear, to be represented by an attorney, and to request a jury trial. If you do not have an attorney, you have the right to request the Court to appoint an attorney to represent you and to have the attorney's fees paid for you if you cannot afford to pay them yourself . You also have the right to request that the Court order that an independent evaluation be conducted as to your alleged incapacity. If the Court decides that you are an Incapacitated Person, the Court may appoint a Guardian for you, based on the nature of any condition or disability and your capacity to ",) . ... make and communicate decisions. The Guardian will be of your person and/or your money and other property and will have either limited or full powers to act for you. If the court finds you are totally incapacitated, your legal rights win be affected and you will not be able to make a contract or gift of your money or other property. If the court finds that you are partially incapacitated, your legal rights will also be limited as directed by the Court. If you do not appear at the hearing (either in person or by an attorney representing you) the court will still hold the hearing in your absence and may appoint the Guardian requested. DeLuca, Esquire, who represents and avers as follows: 1. Petitioner is the Area Agency on Aging, in and for Cumberland County, Pennsylvania, with it's office located at 16 W. High Street, Carlisle, Cumberland County, Pennsylvania. 2. The alleged incapacitated person is Sara McAlicher, a widow, age 84, who resides at The West Shore Health and Rehabilitation Center located at 770 Poplar Church Road, Camp Hill, Cumberland County, Pennsylvania and has resided there for a period exceeding one (1) year prior to the filing of this Petition. 3. The only known relative of the alleged incapacitated person is her son: Robert McAlicher 143 Henry Road Enola, Pennsylvania 17025 4. Sara McAlicher has for at least three (3) months been incapable of managing and caring for herself and her financial affairs. 5. Sara McAlicher exhibits symptoms of mental incapacity, including but not limited to history of dementia and failure to thrive. 6. Sara McAlicher's mental incapacity prevents her from managing and caring for the affairs of her person and estate. 7. Sara McAlicher's condition has deteriorated in that: a. She appears disoriented and confused as to day, date, month, year, and place; and b. She does not ambulate independently and must use a wheel chair. 8. Petitioner believes and, therefore, avers that Sara McAlicher is the joint owner of real estate with her son at 143 Henry Road, Bnola, Pennsylvania. 9. Petitioner has been advised by West Shore Health and Rehabilitation Center that the nursing home bill of Sara McAlicher has not been paid since August, 2000 and over $35,000.00 is due and owing to West Shore Health and Rehabilitation Center for her nursing home care. 10. Petitioner has attempted to obtain the assistance of her son, Robert McAlicher, in resolving the outstanding bill due and owing to the nursing home but he has failed to fully cooperate and has not provided sufficient information concerning her finances. 11. Robert McAlicher has failed to provide any explanation as to why no money has been paid to the nursing home. 12. West Shore Health and Rehabilitation Center has informed Petitioner that the placement of Sara McAlicher at the nursing home facility may have to be terminated unless payment of the outstanding bill is forthcoming. 13. Petitioner, through its authorized representatives, have viewed the home of Sara McAlicher at 143 Henry Road in Enola, Pennsylvania and, as a result thereof, does not believe that it is a safe environment for Sara McAlicher in the event that her residence is terminated by the nursing home. 14. To the best of Petitioner's knowledge, Sara McAlicher does not have a power of attorney. 15. Petitioner believes and, therefore, avers that Robert McAlicher, by ignoring his responsibility to pay the nursing home and by not having a safe environment at home, is not capable of providing the necessary care for his mother. 16. Termination of Sara McAlicher's residence at the West Shore Health and Rehabilitation Center would place her in immediate and irreparable harm. 17. The Petitioner believes and, therefore, avers that Permanent Plenary Guardians of the Person and Estate of Sara McAlicher should be appointed. 18. Less restrictive alternatives are not available because there is no one able to care for her. 19. The Area Agency on Aging, in and for Cumberland County, Pennsylvania is willing to accept appointment as Permanent Plenary Guardians of the Person and Estate of Sara McAlicher and has no interest adverse to that of the alleged incapacitated person. 20. No other Court has ever assumed jurisdiction in any proceeding to determine the incapacity of Sara McAlicher. 21. On or about April 12, 2001, Petitioner filed a Petition for Access to Records in the Court of Common Pleas of Cumberland County, Pennsylvania to No. 01-2193 pursuant to the Older Adults Protective Services Act. 22. On or about July 13,2001, Petitioner filed another Petition for Access to Records to the same number as set forth hereinabove in Paragraph 21 after Robert McAlicher failed to provide complete information as directed by Order of Court dated April 26, 2001. A copy of said Order of Court is attached hereto, marked as Exhibit "A", and incorporated herein by reference. 23. The failure to appoint the Area Agency on Aging, in and for Cumberland County, Pennsylvania as Permanent Plenary Guardian of the Person and Estate of Sara McAlicher would result in irreparable harm to the person and estate of Sara McAlicher. WHEREFORE, Petitioner respectfully requests this Honorable Court issue a rule upon Sara McAlicher, the alleged incapacitated person, with notice thereof to be given to her next-of-kin, and to such other persons as this Court may direct, to show cause why she should not be adjudged an incapacitated person and the Area Agency on Aging, in and for Cumberland County, Pennsylvania be appointed Plenary Guardians of her Person and Estate. Barley Director August 31, 2005 Report from Guardian of Person and Estate Cumberland County Office of Aging Priscilla Whitman, Aging Care Manager III On August 8, 2001, Judge J. Wesley Oler appointed the Cumberland County Office of Aging to be Guardian of Person and Co-Guardian of Estate for Sara McAlicher with her son Robert McAlicher. Ms. McAlicher at that time was residing at West Shore Health and Rehab where she continues to reside. Her admission date to West Shore Health and Rehab was on June 7, 2000. At the time of her admission to West Shore Health and Rehab, Ms. McAlicher was diagnosed with senile dementia Alzheimer's type, senile and pre-senile organic psychotic condition, arteriosclerosis cardiovascular disease and failure to thrive. Her present medical conditions also include congestive heart failure, vascular insufficiency of intestipe, anem~ and polyglandular dysfunction. Her present medications are: Klonopin, Lasix, Coiace ~~ liquid, Potassium Chloride and a Multivitamin with minerals. She was placed in a:~-) ~,~1 restorative dining program after being observed taking a ling time to chew and pocketing- food. A speech screen was requested to assist with feeding. .< (.,) . ~._" Ms. McAlicher continues to require maximum assistance with all her activities of.QailY:::J living and transfers. Recently, her attempts to feed self are not successful and stitt now N w feed her. She has a good appetite and is on a no added salt mechanical soft diet. Her weight is stable. Nursing staff provide a full body check weekly due to skin breakdown and change her colostomy bag and wafer every two days. She is incontinent of urine and is on a toileting schedule. She is non ambulatory and is unable to propel self in wheelchair. Ms. McAlicher is alert to name but displays much confusion and her verbalization is not coherent most ofthe time. She is pleasant with others and cooperative with staff when care is being provided. She usually has a smile and enjoys participating in different activities. She likes singing, bingo and enjoys watching TV in the dayroom with other residents. Ms. McAlicher over the past few months has become more lethargic and at times it is very difficult to waken her. , '---", :::2'.1" in-) --;-'.1 '''''-' 2'') -. f~-I"l >:. (-:-) , , e~ Ms. McAlicher is visited by case manager every 30-60 days at which time her medical record is reviewed. The nursing home staff updates the care manager whenever there are concerns or medical problems. Staff believes son visits every 1-2 weeks. The nursing facility has requested a phone number and address as to where he can be located in case of an emergency. This information has not been provided as of this time. It is the request of the Cumberland County Office of Aging that the agency retains Guardianship of Person for Sara McAlicher. The West Shore Health and Rehab has demonstrated an adequate quality of care for client by managing her daily needs and continuously monitoring her medical conditions. Wesley Oler appointed the Cumberland County Office of Aging to be Guardian of Person and Co-Guardian of Estate for Sara McAlicher with her son Robert McAlicher. Ms. McAlicher at that time was residing at West Shore Health and Rehab where she continues to reside. Her admission date to West Shore Health and Rehab was on June 7, 2000. At the time of her admission to West Shore Health and Rehab, Ms. McAlicher was diagnosed with senile dementia Alzheimer's type, senile and pre-senile organic psychotic condition, arteriosclerosis cardiovascular disease and failure to thrive. Ms. McAlicher over the past year has had a slow medical decline. Nursing provides range of motion exercises as she has less than 50% use of her extremities. She is total assistance with turning and mobility. Ms. McAlicher continues to require maximum assistance with all her activities of daily living and transfers. She continues to be a part of the restorative dining program for every meal and eats about 50% of each meal. She has a decent appetite and is on 20 ounces of protein supplement daily with fortified foods as her diet. Her weight is stable at 130. Nursing staff provide a full body check weekly due to skin breakdown and change her colostomy bag and wafer every two days. She is incontinent of urine and is on a toileting schedule. She is non ambulatory and is unable to propel self in wheelchair. Ms. McAlicher is alert to name but displays much confusion and her verbalization is not coherent most ofthe time. She no longer has the ability to speak in sentences. Due to her dementia her short and long term memory are very poor as well as her recall. Her de9ision making is severely impaired. Ms. McAlicher continues to be lethargic and at times it is almost impossible to waken her. Ms. McAlicher is visited by case manager every 30-60 days at which time her medical record is reviewed. The nursing home staff updates the care manager whenever there are concerns or medical problems. Staff believes son visits every 1-2 weeks. The nursing facility has requested a phone number and address as to where he can be located in case of an emergency. This information has not been provided as of this time. It was noted in the chart and by staff of different incidents where son's visits have been disruptive to those involved. The Office of Aging was finally able to set up a funeral for Ms. McAlicher that was paid in full. It is the request of the Cumberland County Office of Aging that the agency retains Guardianship of Person for Sara McAlicher. The West Shore Health and Rehab has demonstrated an adequate quality of care for client by managing her daily needs and continuously monitoring her medical conditions. The son visits several times a week and assists with feeding her lunch. I pointed this out as being incorrect and it was corrected. The case managers made several visits throughout the year and care plan meetings were attended. Due to her dementia her short and long term memory are very poor as well as her recall. She is pleasant with others and cooperative with staff when care is being provided. She usually has a smile and enjoys participating in different activities. She continues to be a passive participant in different activities. Hospice restarted providing additional care in February. A hospice nurse visits twice a week and a home health aide visits three times a week. The nurse calls the care manager at least once a week to give her updates. The Hospice chaplain also visits with her. In March it appears as though she had a small stroke that affected her left side. Over the past year Ms. McAlicher continued to decline in health due to her' dementia diagnosis. She is more contracted and responds very little to verbal questions. Last year she was diagnosed with polyglandular dysfunction, CHF, and degenejrative joint disease. In February of this year she was diagnosed as having End Stage !Adult Failure to Thrive. Ms. McAlicher continues to require maximum assistance with all her activities of daily living and transfers. Her movement is reduced and she spends more time bleeping. Client has a poor appetite and her diet consists of fortified milk, ice cream,' health shakes, regular liquids and pureed foods. As of this time, her weight is stale and she is no longer receiving care from Hospice. Nursing staff changes her colostonhy bag and wafer every two days. She is incontinent of urine and is on a toileting scheldule. She is non-ambulatory and is unable to propel self in wheelchair. Ms. M~Alicher has been moved to the Advanced Alzheimer's Care Unit. Mls. Within a two week period of time in February, Ms. McAlicher experienced ~nro falls out of the bed. Apparently she had received a new air circulating mattress with the air circulating on one side, then the other, and then in the middle which was supposed to help prevent skin breakdown. However it was determined that when the air circulated on the one side it actually rolled her off the bed. She received a different type of mattress and there have been no more falls. It is the request of the Cumberland County Office of Aging that the agency retains Guardianship of Person for Sara McAlicher.
