McConnell of 30 Seneca Drive, York Springs, Pennsylvania, is about to execute contemporaneously herewith, a contract, wiIh Musser Home Builders, Inc. of 159 Locust Grove Road, Dillsburg, Pennsylvania, for the erection of a building upon premises commonly known as 1610 Fox Hollow Road, Township Lower Allen, Cumberland County, Pennsylvania, as set forth in Ihe deed dated ' recorded at Deed Book , Page , in Ihe Recorder's Office for Cumberland County, Pennsylvania, as more specifically described in Exhibit" A" which is incorporated herein and attached hereto. NOW, August 26, 2005, at the time of and immediately before Ihe execution of the principal contracl, and before any authority has been given by the said Owner to Ihe said Contractor to commence work on Ihe said building, or purchase materials for the same in consideration of Ihe making of Ihe said contract wiIh Contractor and Ihe further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be tiled against the building by the Contractor, or any subcontractor, nor by any of Ihe materialmen or workmen or any oIher person for any labor, or materials purchased, or extra labor or materials purchased for Ihe erection of said building, Ihe right to file such liens being expressly waived.
