STIPULATION AGAINST LIENS
WHEREAS, Emily G. McAuliffe is about to execute
contemporaneously herewith, a contract with McGraw-Lock Builders for
the erection of a single family dwelling upon All that certain plat,
tract, parcel or lot of land located in North Middleton Township,
Cumberland county, pennsylvania, being more particularly bounded and
described as follows, to wit:

Middleton Township, Cumberland County, pennsylvania, bounded and
described as follows, to wit:
Beginning at a point on the western right-of-way line of West View (a
fifty foot right-of-way) said point being located North zero degreeS,
ten minuets, nineteen seconds West (N 00010'19" W), a distance of
three hundred forty-three and fifty-three hundredth feet (343.53')
from the terminus of a curve connecting said right-of-way line with
the northern right-of-way line of Long View; thence from said point
of Beginning, by Lot No. 26 south eighty-nine degreeS, forty-nine
minutes, forty-one seconds West (S 89049'41" W), a distance of one
hundred ninety and thirty-two hundredth feet (190.32'), to a point;
thence by Lot No. 105 of Cross Creek and by land now or late of Carl
Eugene Jumper North zero degrees, nine minutes, six seconds West (N
00009' 06" W), a distance of eighty feet (80.00'), to a point; thence
by Lot No. 24 North eighty-nine degreeS, forty-nine minutes,
forty-one seconds East (N 91049'41" E), a distance of one hundred
ninety and thirty hundredth feet (190.30') to a point on the western
right-of-way line of West view; thence by said right-of-way South
zero degreeS, ten minutes, nineteen seconds East (S 00010'19" E), a
distance of eighty feet (80.00') to a point, the place of Beginning.
said tract contains l5,224.86 square feet or 0.350 acres.
Being Lot No. 25 on the Final Subdivision Plan for North Ridge phase
6, prepared by Hartman and Associates Engineers and surveyors.
NOW, THEREFORE, it is hereby stipulated and agreed by and
between the parties as part of said contract and for consideration
therein set forth that nether the undersigned contractor nor any
subcontractor or material men nor any other person furnishing labor
or materials to the contractor under the subject contract shall file
a lien for work performed or materials furnished to the building or
any part thereof.
The General Contractor hereby agrees to waives any defects in
the filing and indexing of this lien waiver in the Office of the
prothonotary where it is to be filed pursuant to section l402 of the
Mechanics' Lien Law of 1963, and agrees that it will not contest the
validity of the lien based upon any such defect, and hereby agrees to
this waiver of defects on behalf of any of the subcontractors,
material men or suppliers that may provide any labor or material
under the General contractor's agreement with the Owner and who, but
for the same waiver, would be entitled to assert mechanics' lien
against the owner's property under t:~ j\echani s' Lien Law of 1963.
