custody of the child and claims to have custody or visitation rights

The best interest and permanent welfare of the child will be served by granting the relief
request because:
Plaintiff has undertaken and performed the primary parental responsibilities for the child.
Plaintiff is best able to provide the care and nurture which the child needs for healthy
development.
Defendant frequently abuses alcohol and is therefore unreliable as custodian of the child.
Defendant's frequent abuse of drugs as well as alcohol renders him incapable of
transporting the child safely.
A Court Order of custody and structured visitation is desired so that the Plaintiff and the
child may plan their schedules accordingly, and so that misunderstandings and unmet
expectations regarding custody and visitation can be avoided, and also so that the child is
not used in a manipulative fashion.
A Court Ordered determination of custody is required to avoid continuing conflict
between the parties regarding responsibility for custody and support.
WHEREFORE, Plaintiff requests this Court grant Plaintiff primary physical custody of
the child subject to structured partial custody by the Defendant.

it is hereby directed that parties and their respective counsel appear before Jacqueline M. Verney, Esq. , the conciliator,
at 4th Floor, Cumberland County Courthouse, Carlisle on Tuesday, October 25, 2005 at 10:39 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. All children age five or older may also be present at the conference. Failure to appear at the conference may
provide grounds for entry of a temporary or permanent order,

AND NOW, this .7-7/tday of ': , 2005, upon
consideration of the attached Custody Conciliation Report, it is ordered and directed as
follows:
1. The Mother, Summer Trimble, and the Father, Steven Wilson, shall have
shared legal custody of Destiny Wilson, born August 24, 2004. Each parent shall have an
equal right, to be exercised jointly with the other parent, to make all major non-
emergency decisions affecting the Child's general well-being including, but not limited
to, all decisions regarding her health, education and religion.
Mother shall have primary physical custody of the child.
3. Father shall have periods of partial physical custody as follows:
A. Beginning October 28, 2005, every weekend from Friday at 6:00 p.m.
to Sunday at 6:00 p.m.
B. Such other times as the parties agree.
4. Holidays. The parties shall have physical custody of the Child as
indicated below:
A. Thanksgiving shall be shared from 9:00 a.m. to 3:00 p.m. and 3:00
p.m. to 9:00 p.m. as agreed by the parties.
B. Christmas shall be divided into two Blocks. Block A shall be from
Christmas Eve at 12:00 noon to Christmas Day at 12:00 noon. Block
B shall be from Christmas Day at 12:00 noon to December 26 at 12:00
noon. Father shall have Block A in odd numbered years and Block B
in even numbered years. Mother shall have Block A in even
numbered years and Block B in odd numbered years.
C. Summer. Each party shall be entitled to two consecutive weeks in the
summer provided they give the other party 30 days prior notice.
D. Birthday. Each party shall be entitled to at least two hours with the
child on her birthday.
E. Mother's Day/Father's Day- Mother shall have physical custody of the
Child on Mother's Day from 9:00 a.m. to 6:00 p.m. Father shall have
physical custody of the Child on Father's Day from 9:00 a.m. to 6:00
p.m.
5. Father shall be responsible for transportation.
6. This Order is entered pursuant an agreement of the parties at a Custody
Conciliation Conference. The parties may modify the provisions of this Order by mutual
consent. In the absence of mutual consent, the terms of this Order shall control.

(b). Petitioner believes that the safety and well being of the minor child is in jeopardy.
5. The best interest of the child will be served by the Court in modifying said Order.
WHEREFORE, Petitioner prays this Court to grant the modification of the Custody Order

2. Respondent is Steven Wilson, who is currently incarcerated at the Cumberland County
Prison, Carlisle, Pennsylvania 17013.
3. On February 8, 2007, the Honorable J. Wesley Oler, Jr., entered the following Custody
Order: Attached as Exhibit "A."
4. Since the entry of said Order, there has been a significant change in circumstances in that:
(a). Respondent is serving a six (6) month jail term at the Cumberland County Prison.
(b). Before being incarcerated Respondent was not following the current Custody Order.
(c). Respondent was not using the proper car seat to transport the minor child, Destiny
Wilson, date of birth, 8/24/07.
5. The best interest of the child will be served by the Court in modifying said Order.
WHEREFORE, Petitioner prays this Court to grant the modification of the Custody
Order as follows: Primary physical custody in Petitioner with visitation in Respondent as agreed
upon by the parties.

3. The Honorable J. Wesley Oler, Jr. previously entered an Order of Court
dated October 27, 2005 providing for shared legal custody, Mother having primary
physical custody and Father having every weekend.
4. The parties agreed to an Order in the form as attached.

AND NOW, Friday, January 11, 2008 , upon consideration of the attached Complaint,
it is hereby directed that parties and their respective counsel appear before Jacqueline M. Verney, Esq. , the conciliator,
at 4th Floor, Cumberland County Courthouse, Carlisle on Monday, February 11, 2008 at 9:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary
order. Failure to appear at the conference may provide grounds for entry of a temporary or permanent order.
The court hereby directs the parties to furnish any and all existing Protection from Abuse orders,
Special Relief orders, and Custody orders to the conciliator 48 hours prior to scheduled hearing.

consideration of the attached Custody Conciliation Report, it is ordered and directed as
follows:
1. The prior Order of Court dated February 13, 2008 is hereby vacated.
2. The Father, Steve Wilson, and the Mother, Summer Trimble, shall have
shared legal custody of Destiny Wilson, born August 24, 2004. Each parent shall have an
equal right, to be exercised jointly with the other parent, to make all major non-
emergency decisions affecting the Child's general well-being including, but not limited
to, all decisions regarding her health, education and religion. Pursuant to the terms of 23
Pa.C.S. §5309, each parent shall be entitled to all records and information pertaining to
the child including, but not limited to medical, dental, religious or school records, the
residence address of the child and the other parent. To the extent one parent has
possession of any such records or information, that parent shall be required to share the
same, or copies thereof, with the other parent within such reasonable time as to make the
records and information of reasonable use to the other parent. Both parents shall be
entitled to full participation in all educational and medical/treatment planning meetings
and evaluations with regard to the minor child. Each parent shall be entitled to full and
complete information from any physician, dentist, teacher or authority and copies of any
reports given to them as parents including, but not limited to: medical records, birth
certificates, school or educational attendance records or report cards. Additionally, each
parent shall be entitled to receive copies of any notices which come from school with
regard to school pictures, extracurricular activities, children's parties, musical
presentations, back-to-school nights, and the like.
3. During the school year, Mother shall have primary physical custody of the
child.
4. During the school year, Father shall have periods of partial physical
custody every weekend from Friday at 4:00 p.m. to Monday morning when Father shall
be responsible for getting the child to school. In the event it is not possible for Father to
get the child to school, then Father's period of physical custody shall end at 6:00 p.m. on
Sunday. Father shall provide prior notice to Mother is he is keeping the child until
Monday morning.
5. During the summer, the parties shall share physical custody of the child on
a week on/week off basis, with Friday at 4:00 p.m. being the date and time of transfer.
Father shall have the first week after school recesses.
6. Transportation shall be shared such that the receiving party shall transport,
except that Father is responsible for getting the child to school on Monday mornings.
7. The parties shall personally discuss custody issues or text each other.
8. Holidays:
A. Thanksgiving shall be shared such that Mother shall always have
physical custody from 9:00 a.m. to 3:00 p.m. and Father shall always have
physical custody from 3:00 p.m. through the weekend.
B. Christmas shall be divided into two Blocks. Block A shall be from
12:00 noon on Christmas Eve to 12:00 noon on Christmas Day. Block B
shall be from Christmas Day at 12:00 noon to December 26 at 12:00 noon.
Mother shall have physical custody of the child for Block A in odd
numbered years and Block B in even numbered years. Father shall have
physical custody of the child for Block A in even numbered years and
Block B in odd numbered years.
C. Mother shall have physical custody of the child for Mother's Day from
9:00 a.m. to 6:00 p.m. Father shall have physical custody of the child
from Father's Day from 9:00 a.m. to 6:00 p.m.
D. All other major holidays shall be shared as agreed by the parties.
9. Both parties are prohibited from using illegal drugs or partaking in alcohol
to the point of intoxication immediately before or during their period of physical custody.
10. Neither party shall do nor permit a third party to do, or say anything that
would estrange the child from the other parent, injure the opinion of the child as to the
other parent, or hamper the free and natural development of the child's love and respect
for the other parent.
11. This Order was requested at a Custody Conciliation Conference. The
parties may modify the provisions of this Order by mutual consent. In the absence of
mutual consent, the terms of this Order shall control.
