THIS AGREEMENT made the 15th day of August, 2001, by and between D.
CULLY, INC., t/d/b/a C&C Construction, of 5745 Spring Road, Shermans Dale,
Pennsylvania, hereinafter referred to as Contractor,
AND
MICHAEL J. DZF-.ZlNSKI and CONNIE S. DZEZINSKI, husband and wife, of 25 North
Corporation, Apt. #2, Newville, Pennsylvania, hereinafter referred to as Owner, and
whereby the former undertook and agreed to build and construct a newly constructed
single family residence on that certain lot of ground known as:
ALL THAT CERTAIN tract of land situate in West Pennsboro Township,
Cumberland County, Pennsylvania, bounded and described in accordance with Final
Subdivision Plan for Greystone Acres consisting of nine (9) sheets prepared by Louis J.
Harford, Registered Surveyor, dated June 14, 1996, a copy of which was recorded in the
hereinafter named Recorder's Office in Plan Book 72, Page 70, which Plan is incorporated
herein by reference, as follows:
BEGINNING at a point on the southern line of 50-feet wide Kengrey Drive at the
dividing line between Lots Nos. 43 and 44; thence along said southern line of 50-feet wide
Kengrey Drive, South 77 degrees 05 minutes 46 seconds East a distance of 287.57 feet
to a point at the dividing line between Lots Nos. 42 and 43; thence along said dividing line
between said Lots Nos. 42 and 43, South 12 degrees 54 minutes 15 seconds West a
distance of 306.02 feet to a point on line of land now or formerly of Dean E. Chamberlin
and wife; thence along the northern line of said land now or formerly of Dean E.
Chamberlin and wife, North 76 degrees 56 minutes 58 seconds West a distance of 287.57
feet to a point at the dividing line between said Lots Nos. 43 and 44; thence along said
dividing line between said Lots Nos. 43 and 44, North 12 degrees 54 minutes 15 seconds
East a distance of 305.26 feet to a point on the southern line of 50-feet wide Kengrey Drive
at the Place of BEGINNING,
THE ABOVE described tract of land is all of Lot No. 43 as shown on said Final
Subdivision Plan for Greystone Acres, recorded in Plan Book 72, Page 70, and contains
an area of 2.02 acres, more or less.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor,
for and in consideration of the sum of One and 00/100 Dollar ($1.00) to Contractor in hand
paid by Owner, the receipt whereof is hereby acknowledged, and the further consideration
mentioned in the agreement aforesaid, for themselves and their subcontractors, and all
parties acting through or under them, covenant and agree that no mechanic's liens or
claims shall be filed or maintained by them or any of them against the said buildings and
the lot of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or
about the erection and construction of the said buildings on the lot above described, and
the said Contractor, for themselves, their subcontractors and others under them hereby
expressly waive and relinquish the right to have, file, and maintain any mechanic's liens
or claims against the said buildings or any of them, and agree that this instrument, waiving
the right of lien, shall be an independent covenant.
