Plaintiff, Ronald Yates is an adult individual who resides at 90 Fairview Street, Carlisle, Cumberland County, Pennsylvania. 2. Defendant, John Sopensky is an adult individual who resides at 30 East Maplewood Avenue, Mechanicsburg, Cumberland County, Pennsylvania. 3. At all times material hereto, Plaintiff was in the business of construction and remodeling and general maintenance. 4. In June, 2004 Plaintiff and Defendant entered into an oral agreement for Plaintiff to perform construction, repairs and maintenance at Defendant's real estate on Trindle Road, Carlisle, Cumberland County, Pennsylvania. 5. In consideration of Plaintiffs promise to perform certain construction, SAIDIS SHUFF, FLOWER & LINDSAY A77ORNEYS•AT•LAW 26 W. High Street Carlisle, PA repairs and maintenance, Defendant agreed to pay Plaintiff on a time-and-materials basis for the work, at an hourly rate of $18.00 per hour. Defendant agreed to pay the cost of all materials that Plaintiff purchased for use on the job. 6. Plaintiff performed all the work requested by Defendant and agreed to by the parties in a workmanlike and timely fashion, and in accordance with the parties' agreement. 7. Plaintiff has submitted to Defendant invoices for the work that Plaintiff performed at Defendant's real estate in accordance with the parties' agreement, as well as invoices for purchases of materials used on the job. See Exhibits "A," "B," "C" and "D," attached hereto. 8. Despite submission of Plaintiffs invoices and demand for payment, Defendant has failed and refused, and continues to fail and refuse to pay Plaintiff the amount due to Plaintiff for the work described herein. 9. All conditions precedent to Plaintiffs right to be paid for his work have occurred or been satisfied. WHEREFORE, Plaintiff demands judgment in his favor and against Defendant in the amount of $6,136.34, and to include all applicable interest and costs.
