Whereas there are four Orphan's Court matters involved with the
Gerber family from New Cumberland; and
Whereas the accountants filed accounts in some of these Orphan's
Court matters; and whereas of the beneficiaries brought objections and
litigation in the various Orphan's Court matters and;
Whereas the parties have now reached and agreement which has
been memorialized in writing and called the" Family Settlement Agreement
and Release"; and
Whereas the Agreement provides for the Court to carry out several
matters with respect to the agreement as well as enter the Agreement as a
Court Order and;

NOW THEREFORE, your Petitioners Richard C. Rupp, Esquire and,
Esquire for Frederick E. Gerber, II and Jacqueline M. Verney, Esquire as
objectioner, hereby file this Petition to obtain a Court Order to effectuate the
terms of the Family Settlement Agreement and Release and request this
Honorable Court to enter the proposed Court Order to effectuate said Family
Settlement Agreement and Release.
