COMPLAINT Plaintiff, General Electric Capital Corporation, successor In interest to Citicapital Commercial Corporation, successor to Associates Commercial Corporation ("GE"), by and through its undersigned attorneys, Lamm, Rubenstone, Totaro & David, LLC, brings this action against Defendant, Joey V. Sullenberger alkla Joseph Sullenberger ("Sullenberger" or "Defendant") and in support thereof avers as follows: 1. Plaintiff GE is a corporation, organized and existing under the laws ofthe State of Delaware, duly registered to do business in the Commonwealth of Pennsylvania, with a place of business located at 4650 Regent Blvd, Suite 300 Irving, Texas 75063. 2. Defendant Sullenberger, is an adult individual whose last knoWfl address to GE is 481 Sample Bridge Road, Enola, Pennsylvania 17025. 317187-1 BACKGROUND 3. On or about November 15, 1999, Sullenberger and Associates Commercial Corporation ("Associates") entered into a certain Security Agreement (Conditional Sale Contract), No. 211181125 ("Agreement"), which provided for the installment purchase by Sullenberger of a certain 2000 Ford F350 Cab and Chassis VIN IFDWX37F3YEB08933, together with a certain 1999 Century 312 Body, VIN 3120157C99 (collectively the "Truck"), more particularly described in said Agreement. A true and correct copy of the Agreement is attached hereto, incorporated herein, and marked as Plaintiffs Exhibit "A." 4. The Agreement requires Sullenberger, inter alia, to make sixty (60) consecutive monthly payments in the amount of $1,048.03 each, plus applicable taxes, until the entire obligation thereunder is paid in full. 5. Associates properly perfected its security interest in and to the Truck and by recording a Certificate of Title with the Commonwealth of Pennsylvania, in which Associates is listed as the First Lienholder. A true and correct copy of said Certificate of Title for the Truck is attached hereto, incorporated herein and marked as Plaintiffs Exhibit "B". 6. Thereafter, Associates changed its name to, and became knoWfl as, CitiCapital Commercial Corporation ("CitiCapital"); and thereafter, CitiCapital assigned all of its right, title and interest in and to the Agreement and Truck to GE, including its right to pursue legal actions for payment of the Agreement and recovery of the Truck. COUNT I - BREACH OF CONTRACT 7. The averments contained in paragraphs 1 through and including 6 of this Complaint are incorporated by reference as though here set forth in full. 8. Sullenberger breached the terms and conditions of the Agreement and became in default thereof by, inter alia, his failure to make the monthly payments that were due under 317187-1 terms of the Agreement for the month of September 2004 and all payments subsequently due thereafter. 9. Despite repeated demands for payment, Sullenberger has failed and refused to pay the balance due, or any portion thereof, to GE in accordance with the Agreement. 10. In accordance with the terms and provisions of the Agreement, Sullenberger is obligated and liable to GE as follows a. Balance of remaining rentals b. Late charges c. Accrued interest through 9/6/05 TOTAL $3,144.09 459.74 398.47 $4,002.30 Plus continuing interest at the per diem rate of $1. 5 5 11. In accordance with the terms of Agreement, GE is entitled to reasonable attorneys' fees and costs, which are presently in the amount of $1,800.00, and will increase as the instant action proceeds. WHEREFORE, Plaintiff, General Electric Capital Corporation, successor in interest to Citicapital Commercial Corporation, successor to Associates Commercial Corporation, demands Judgment in its favor and against Defendant, Joey V. Sullenberger alkla Joseph Sullenberger in the amount of $5,802.30, plus additional attorneys' fees, costs, interest and such other relief as this Court deems just and proper. COUNT II - REPLEVIN 12. The averments contained in paragraphs 1 through 10 of this Complaint are incorporated by reference as though here set forth in full. 13. Pursuant to the terms and conditions of the Agreement and by virtue of the Certificate of Title to the Truck and The Uniform Commercial Code as in effect in the 317187-1 Commonwealth of Pennsylvania, as well as by reason of the defaults of the Defendant, GE is entitled to immediate possession of the Truck. 14. It is believed and therefore averred that Defendant remains in possession of the Truck to the exclusion of GE. 15. The estimated value of the Truck is believed to be not in excess of $18,000.00. 16. Although frequent demands have been made upon the Sullenberger, Defendant has failed, refused and neglected to deliver possession of the Truck to GE. WHEREFORE, Plaintiff, General Electric Capital Corporation, successor in interest to Citicapital Commercial Corporation, successor to Associates Commercial Corporation, demands Judgment in its favor and against Defendant, Joey V. Sullenberger alk/a Joseph Sullenberger, for possession of the collateral, the 2000 Ford F350 Cab and Chassis VIN IFDWX37F3YEB08933 and 1999 Century 312 Body, VIN 3120157C99, or its equivalent value, plus additional attorneys' fees, costs, interest and such other relief as this Court deems just and proper.
