IN CHANCERY NO. 237'13 TERRI L YN BARR-MARKS ~ /~2"-~S"'-~ Defendant FINAL DECREE OF DIVORCE THIS CAUSE came on to be heard this day upon the Bill of Complaint filed herein by the Complainant, Scott Nelson Marks, by counsel, and upon acceptance of service by the Defendant by signing the Proof of Service, upon the Defendant's waiver of all statutory waiting periods, upon the depositions of the Complainant and his corroborating witness; and I T APPEARING TO TIlE COURT that the parties hereto were lawfully married on September 9, 1995 in Carlisle, Pennsylvania; that there were no children born to the marriage, born to either and adopted by the other or adopted by both; that the parties have maintained within this Commonwealth, a matrimonial domicile at the time of separation of the parties upon which grounds for divorce or separate maintenance is based or at the time the cause of action arose for divorce or at the time of commencement of such suit and the Complainant resides herein and has been an actual and bonafide resident and domiciliary of the Commonwealth of Virginia for at least six (6) months next preceding the institution of this suit; that the Complainant and Defendant are both over the age of eighteen (18) and neither is presently a member of the Armed Forces of the United States; that the parties last cohabitated as man and wife on October 14, 2003 in Loudoun County, Virginia, and at that time it was the intention of at least one of the parties that the separation be permanent; that the parties here to have lived separate and apart, without cohabitation for a period exceeding six (6) months, namely since on or about October 14, 2003, with the intention of remaining permanently separated; that the parties entered into a Property Settlement Agreement on March 17, 2004 which resolves all outstanding issues between them. UPON CONSIDERATION WHEREOF, the Court doth ADJUDGE, ORDER and DECREE that the Complainant, Scott Nelson Marks be and he hereby is, granted a Decree of Divorce a vinculo matrimonii from the Defendant, Teri Lyn Barr-Marks, on the grounds that the parties have lived separate and apart, without any cohabitation and without interruption, since October 14, 2003, constituting a period in excess of six (6) months, and that there is no hope or probability of a reconciliation; and it is further The Court doth further ADJUDGE, ORDER and DECREE that the Property Settlement Agreement of March 17, 2004 be ratified, approved and confirmed and incorporated but not merged into this Decree. The Court doth further ADJUDGE, ORDER and DECREE that the Clerk of this Court shall furnish a certified copy of this Final Decree of Divorce to each of the parties. AND THIS DECREE IS FINAL.
