NOW THI REFORE. it is stipulated and agreed between the parties, as part of

materialmen, nor any person furnishing labor and materials under the contract or any supplemental
contract, may file a lien. cOIDDlOnly called a Mechanics' Lien, under the contract or any
supplemental :contracr, oral or written, for worlc done or materials furnished, such right being
expressly waived. Contractc r warranrs and represents that no worlc of any kind has been done and
no materials have been fim ished, delivered or ordered in connection with the contract or any
supplemental contract for ex ra wo:dc. Contractor further agrees to indemnify Owner from any and
all damages, costs and expcr ses, including reasonable attorneYs fees suffered by Owner as a result
of any lien filed or claim asserted against 1be property by Contractor, or any subcontractor.

BEGINNING at a pofnt on the southern line of Heritage Court cuI de sac having a radius of 50 feet at the
dividing line between Lots Nos. 35 and 36; thence along northern line of said Heritage Court cui de sac by a
CUNe to the left. having a radius of 50 feet an arc distance of 50.00 feet to a point at the dividing line between
Lots Nos. 36 and 37; thence along said dividing line belween said Lots Nos. 36 and 37. the following two (2)
