hereinafter referred to as Contractor,
AND
MICHAEL A. BURDICK AND JEAN M. BURDICK AND SCOTT A. MILLIGAN AND LISA M. MILLIGAN
hereinafter referred to as Owner, whereby the former undertook and agreed to construct a
single family dwelling, in LOT #4 RIDGE ESTATES, MIDDLESEX TOWNSHIP, CUMBERLAND COUNTY,
PENNSYLVANIA, more particularly described in attached e~hibit "AN,
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of ONE Dollar to Contractor it in hand paid by Owner, the
receipt whereof is hereby acknowledged, and the further consideration mentioned in the
agreement aforesaid, for themselves and their subcontractors, and all parties acting
through or under them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said buildings and the lot of
ground appurtenant thereto for or on account of any work done or materials furnished by
them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the l~t above described, and the said
Contractor, tor themselves, their subcontractors and others under them hereby expressly
waive and relinquish the right to have, file, and mainta,in any mechanic's liens or claims
against the said buildings or any of them, and agree that this instrument, waiving the
right of lien, shall be an independent covenant.

ofCumberIand, Commonwealth of Pennsylvania, bounded and described as follows:
BEGINNING AT A POINT in South Middlesex Road (T-590), at a common property corner of
Lot #3 and Lot #4 of the Final Subdivision Plan for Ridge Estates; thence through South
Middlesex Road (1"-590), North 08 degrees 30 minutes 00 _:ends West, a distance of 235.00
feet to a point at a common property comer of Lot #4 and lands now or late of Walter D. &
Gwendolyn Sunday; thence along said lands now or late of Walter D. & Gwendolyn Sunday,
North 90 degrees 00 minutes 00 seconds East, a distance of 455.00 feet to a point at a common
property comer of Lot #4, Lot #5 and lands now or late of Walter D. & Gwendolyn Sunday;
thence along said Lot #5, South 08 degrees 30 minutes 00 seconds East, a distance of 167.75
feet to a point at a comnion property comer of Lot #3, Lot #4 and Lot #5; thence along said Lot
#3, South 81 degrees 30 minutes 00 seconds West, a distance of 450.00 feet to a point in'South
Middlesex Road, said point being TIIE POINT OF BEGINNING.
CONTAINING a gross area of 90,618.09 square feet (2.0803) lLcres and a net area of 84,492.62
square feet (1.9397 acres) to the Dedicated Right-of-Way Line of South Middlesex Road (1'-
590); and being known as Lot # 4 on a plan recorded in the Office of recorder of Deeds for
Cumberland County, Pennsylvania in Plan Book 91 and Page 8. And being known and numbered
118 365 South Middlesex Road, Carlisle, Pennsylvania 17013.
BEING THE SAME PREMISES which Land Market Incorporated, a
Pennsylvania Corporation by its Deed dated August 13, 2005 and
about to be recorded in the Office of the Recorder of Deeds in
and for Cumberland County, Pennsylvania, granted and conveyed
unto Scott A. Milligan and Michael A. Burdick, as joint tenants
with rights of survivorship, Mortgagors herein.
