HomeMy WebLinkAbout05-4265 Cf; -~J(,~ mLD NO LIEN AGREEMENT WHEREAS, an agreement was entered into between, Chateau Custom Home Builders, Inc., "CONTRACTOR", of 160 Lamont Street, New Cumberland, PA 17070 and Lawrence A. Van Loon and Jean Van Loon, his wife, of 249 North 2ih Street, Camp Hill, PA 17011 "OWNERS". Whereby the said contractor undertook and agreed to perform certain work necessary to erect a building on the real estate of the owners situate at 18 Stone Spring Lane, Lot 2, Camp Hill, Cumberland County, Pennsylvania. That the said Contractor, for and in consideration of the sum of One ($1.00) Dollar in hand paid to it by Owner, the receipt whereof is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for itself and its subcontractors, and all parties acting through or under it or them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by it or any of them against the said improvements and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by it or any of them under said contract or otherwise, for, towards, in or about the erected and construction of the said improvements on the lot above described, and the said Contractor, for itself, its subcontractors and others under it hereby expressly waives and relinquishes the right to have, file, and maintain any mechanic's liens or claims against the said buildin~ls or any of the improvements, and agrees that this instrument, waiving the right of lien, shall be an independent covenant. this IN ~ITNESS WHEREOF, the said contractor has executed this agreement II r day of August, 2005. v Exhibit (A) ALL THAT CERTAIN lot or piece ofland situated in the Township of Hampden, Cumberland County, Pennsylvania. being Lot No.2 on a subdivision Plan made for George S. and Dorothy S. Ferencic, by D. P. Raffensperger Associates, dated March 22,1971, recorded in the Office of the Recorder of Deeds in and for Cumberland County, in Plan Book No. 22 at Page 66, bounded and described in accordance with said plan as follows: LOT NO.2 - BEGINNING at an iron pin at the Southeast corner of Lot No. I; thence along said Lot No. I North 15 degrees 28 minutes West 110 feet to an iron pin in hne ofland now or formerly ofK R. Elicker; thence along said land and crossing Stone Spring Lane, a private road, North 68 degrees 15 minutes East 225 feet to a point on the bank of the Conodoguinet Creek; thence along said Creek South II degrees 22 minutes East 111.l6 feet to a comer ofland now or formerly of Emma J. Cooper; thence along said land and re-crossing Stone Spring Lane South 68 degrees 15 minutes West, passing over an iron pin 4.42 feet from the beginning of this line, for a total distance of 217 feet to the first mentioned point and place of BEGINNING. TOGETHER with the use of the aforesaid Stone Spring Lane, a private road, extending down said Creek to a public road, said use to be in common with other owners and occupiers of land abutting on said road and entitled to the use thereof. TOGETHER with an easement in favor of Grantees, as well as the present and future owners of Lot No.2 on said Plan, their heirs and assigns, for the purpose of installing, constructing, erecting, laying, using, operating, maintaining, inspecting, and repairing a water line and accessories and appurtenances, within and under the lands of the present and future owners of Lot I on said plan, together with all rights of ingress, egress, and regress into, over, upon. through, along and from said land which are necessary and convenient for the full and complete use by Grantees, their heirs and assigns, of the said right-of-way and easement. The land subject to this easement shall consist of a permanent 10 foot right-of-way located within the westerly 10 feet of Lot No. I, more particularly described as follows: BEGINNING at an existing concrete monument located at the northwest comer of Lot No. I at the boundary line of Lot No.2, thence South 15 degrees 28 minuets 00 seconds East a distance of 10.06 feet; thence South 68 degree 15 minutes 00 seconds West a distance of 195.00 feet to a point at the right-of-way line of Hillcrest Road; thence North 15 degrees 28 minutes 00 seconds West a distance of 10.05 feet to a concrete monument; thence North 68 degrees 15 minutes 00 seconds East a distance of 195.00 feet, to the point and place of BEGINNING. SUBJECT, NEVERTHELESS, to an easement in favor of the present and future owners of Lot No. I on the aforesaid Plan of Lots for the purpose of using, operating, maintaining. inspecting and repairing a sewer line within and under the lands of Lot No.2 on the aforesaid Plan of Lots in order to connect with the sewer collection line of the Hampden Township Sewer Authority located within Stone Spring Lane, which crosses Lot No.2 on the aforesaid Plan as shown on said Plan. The easement granted herein shall include all rights of ingress, egress, and regress into, over, upon, through, along and from said land which are necessary or convenient for the full and complete use by the Grantees, their heirs and assigns. of the said right-of-way and easements. BEING THE SAME PREMISES which Jaine Weise, also known as Jaine F. Weise, single woman, by Deed dated April 20, 2005 and recorded April 22, 2005 in the Office ofthe Recorder of Deeds in and for Cumberland County, Pennsylvania in Deed Book 268.
