HomeMy WebLinkAbout05-4340 STIPULATION AGAINST LIENS LAWMEN CONSTRUCTION, LLC, Owner IN THE COURT OF COMMON PLEAS CUMBERLAND COUNTY, PENNSYLVANIA versus 05- /-lJlfO MLD TERM LAWMEN CONSTRUCTION, LLC, Contractor Whereas, LA WMEN CONSTRUCTION, LLC, a Pennsylvania Limited Liability Company, of 149 Kerrs Road, Carlisle, Cumberland County, Pennsylvania is about to execute contemporaneously herewith, a contract with LA WMEN CONSTRUCTION, LLC, a Pennsylvania Limited Liability Company, of 149 Kerrs Road, Carlisle, Cumberland County, Pennsylvania, for the erection of a residential dwelling house upon a lot ofland situate in Upper Frankford Township, Cumberland County, Pennsylvania, being known as Lot No. 18 on the subdivision plan prepared by Eric Diffenbaugh, RPLS dated November II, 2004, and recorded in the Office of the Recorder of Deeds for Cumberland County in Plan Book 91, Page 10. Legal Description: BEGINNING at a point in western edge ofDeervi,~w Drive at Lot No. 12; thence along Lot No, 12 South 45 degrees 48 minutes 22 seconds West 464.15 feet to an iron pin set; thence along lands now or formerly ofR. Duane Wickard North 43 degrees 03 minutes 29 seconds West 72.04 feet to an existing iron pin; thence along lands now or formerly of Richard I. Slusser North 45 degrees 54 minutes II seconds West 252.08 feet to an iron pin set; thence along Lot No. 17 North 45 degrees 48 minutes 22 seconds East 470.24 feet to a point; thence along western edge of Deerview Drive on plan South 44 degrees II minutes 38 seconds East 324.00 feet to a point; the Place of BEGINNING. Now, August 18, 2005, at the time of and immediately before the eXI:cution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration ofthe making ofthe said contract with it and the further consideration of one Dollar, to Contractor paid by Owner it is agreed that no lien shall be filed against the building by the contractor, or any sub-contractor, nor by any ofthe material men or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived.
