WHEREAS, Douglass E. Baughman and Dana N. Baughman of 1435 Hillcrest Court, Camp Hill,
Pennsylvania, is about to execute contemporaneously herewith. a contract, with Musser Home Builders,
Inc. of 159 Locust Grove Road, Dillsburg, Pennsylvania, for the erection of a building upon premises
commonly known as 3410 anyon Creek. Township Lower Allen. Cumberland County, Pennsylvania. as
set forth in the deed dated J ,recorded at Deed Book , Page , in the
Recorder's Office for Cumberland ounty, Pennsylvania, as more specifically described in Exhibit "A"
which is incorporated herein and attached hereto.
NOW, August 22. 2005, at the time of and immediately b.:fore the execution of the principal
contract. and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased. or extra
labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL THAT CERTAlr\ftract or parcel of land situatE! in the Township of Lower
Allen, Cumberland County, Pennsylvania; said premises being known as Lot No. 25 as
shown on the Revised Subdivision Plan for High Meadow Phase V Lots 25, 32, dated
May 23, 2005, and last revised August 1, 2005, and recorded August 19, 2005, in the
Cumberland County Recorder of Deeds Office in Plan Book 91, Page 27, and said
premises being further bounded and described as follows:
BEGINNING AT A POINT on the Southern line of Canyon Creek, said point
being the Northeast corner of Lot No. 25 and labeled as Point of Beginning on the
attached Plat; thence along the Western property line of Lot No. 26, South 10 degrees
16 minutes 00 seconds West, a distance of 35.00 feet to a point; thence along said
Western property line of Lot No. 26, South 01 degree 20 minutes 53 seconds West, a
distance of 122.71 feet to a point; thence along the Northern property line of Lot "A",
South 75 degrees 09 minutes 13 seconds West, a distance of 88.69 feet to a point;
thence along the Eastern property line of Lot "A", North 14 degrees 46 minutes 45
seconds West, a distance of 180.25 feet to a point on the Southern line of Canyon
