C.S. S 5326, Lumbermens Mutual Casualty Company ("Lumbermens") and the Universal Bonding Insurance Company Recovery Trust (the "UBIL Recovery Trust") (collectively the "Intervenors"), hereby request that the Court order the Prothonotary to issue a subpoena to compel the production of documents and things directed to the corporate representative(s) of Doran Excess Underwriters, Inc., and in support thereof, state as follows: I. Lumbermens and the UBIC Recovery Trust are intervenors in a civil action pending before the Superior Court of New Jersey Chancery Division: Morris County ("New Jersey Court"), captioned Executive Risk Indemnity, Inc. v. National Program Services, Inc., et al., and Combined Specialty Insurance Company, et ai., Docket MRS-C-207-02, and United National Insurance Company v. National Program Services, Inc. and Combined Specialty Insurance Company, et ai., Docket No. MRS-C-12-03. 2. The Intervenors by and through their New Jersey counsel, filed a motion for a Commission for Document Subpoena in the New Jersey Court. 3. On June 29, 2005, the Honorable Kenneth C. Mackenzie, Judge of the New Jersey Court granted the Intervenors' motion, commissioning this Court to "issue a Document Subpoena to Doran commanding it to produce the documents descri.bed on the attached Schedule A." See Ex. I. 2 4. The Intervenors request that this Court order that the documents set forth in the Schedule attached to the Commission be produced pursuant to a subpoena.
