NOTHING, INC. doing business as SOUTH PHILL Y HOAGIES and SCOTT HENRY, Personal Guarantor Defendants COMPLAINT The Plaintiff, US FOODSERVICE, by its attorneys, KNUPP, KODAK & IMBLUM, P.c., brings this action of Assumpsit against the Defendants to recover the sum of ONE THOUSAND EIGHT HUNDRED EIGHTY -FNE DOLLARS AND NINETY-SIX CENTS ($1,885.96), along with interest thereon at the statutory rate from December 22,2004, upon a cause of action of which the following is a statement: 1. The Plaintiff, US FOODSERVICE, is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, having its principal office and place of business at 13 Rutledge Drive, Pittston, Pennsylvania 18640. 2. The Defendant, NOTHING, INC., doing business as SOUTH PHILL Y HOAGIES, is a corporation organized and existing under the laws of the Commonwealth of Pennsylvania, having its principal office and place of business at 4955- A Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania 17055. 3. The Defendant, SCOTT HENRY, Personal Guarantor, is an adult individual residing at 4955-A Carlisle Pike, Mechanicsburg, Cumberland County, Pennsylvania 17055. 4. Plaintiff, at the special instance and oral request of the Defendants, sold and delivered goods, wares and merchandise to the Defendants. F:\USER\ROB1N\CCP&DJ CMPS\CCP COMPLAINTS\USF00D31483.wpd:27Sep05 2 6. The prices charged for said goods, wares and merchandise were just and reasonable, were the legal and market prices therefor and were the prices which the Defendants orally promised and agreed to pay to Plaintiff. 7. Plaintiffs Invoices are not attached to this pleading due to the voluminous nature of same and have previously been provided to Defendants. 8. The balance due and owing by Defendants to Plaintiff is the sum of One Thousand Five Hundred Seventy- One Dollars and Sixty -Three Cents ($1,571.63) as appears on Plaintiffs Statement of Account hereto attached, marked as Exhibit "A" and made a part hereof. 9. Due to the default of Defendants, and pursuant to the terms and conditions of the Credit Application and Personal Guaranty executed by Defendants, hereto attached, marked Exhibit "B" and made a part hereof, attorney's fees in the total amount of Three Hundred Fourteen Dollars and Thirty-Three Cents ($314.33) have ben added to said account. 10. Plaintiff frequently demanded payment from Defendants of said amount due and owing as aforesaid, but Defendants refused and neglected and still refuse and neglect to pay said amount of any part thereof. WHEREFORE, Plaintiff brings this suit to recover from Defendants the sum of ONE THOUSAND EIGHT HUNDRED EIGHTY-FIVE DOLLARS AND NINETY-SIX CENTS ($1,885.96), along with interest thereon from December 22, 2004.
