WHEREAS, virginia R. Adams, ot 917 West Luther Street
Carlisle, PA 17013 (the "owner") the owner of the hereinafter
described tract of land, has executed or is about to execute
contemporaneously herewith a contract with Le. Adams d/b/a Budget
Excavating and Contracting of 23 Prey Lane, Galeton, PA 169a2
(the "Contractor") for improvements to the premi.es located at
478 Stonehouse Road, Newville, CUmberland CClunty, Pennsylvania
17241, more particularly clescribed on ":Exhibit A" attached hereto
and made a part hereof (the "Premises").
NOW, September ~~ 2005, betore any authority has been
given by said owner to the said Contractor to commence work on
.aid Premises or to otherwi.e construct any improvements thereto,
or to purchase materials tor the same, or to enter into any
contract. with any subcontractors, or materia.lmen. or to
authorize any purchases by or through any subcontractors or
materialmen, in consideration of the making of .aid contraot with
the Owner and the further consideration of One Dollar ($1.00), to
Contractor paid by said Owner, and with the intent of all parties
to be legally bound hereby, it is agreed that no.lien shall be
filed against the building or Premises or any part thereof, by
the Contractor or any sUbcontractor, or by any of the materialmen

State of Pennsylvania, more fully described as follows, to-wit:
BEGINNING at a point in the Mount Rock road leading from Walnut Bottom Road to thJ Ritner
Highway at comer of lands now or formerly of Alice M. Moore known as the Stone HoUse Lot;
thence by the Stone House Lot South Seventy (70) degrees West One Hundred Fifty (15/)) feet;
thence by other land of J. Earl Weibley and wife, North Seventeen (17) degrees Thirteen (13)
minutes West One Hundred Ten (110) feet; thence by same North Seventy (70) degrees East One
Hundred Fifty (150) feet to the center of Mount Rock Road; thence by center of said road South
