surviving spouse is 3% [72 P.S. 99116 (a) (1.1) (i)].

[72 P.S. 99116 (a) (1.1) (ii)]. The statute does not exemct a transfer to a surviving spouse from tax, and the statutory requirements for disclosure

1 Sale of Real Estate - All that certain piece or parcel of real estate having erected 95.000.00
thereon a dwelling house being known and numbered as 106 Front Street,
Shiremanstown, Pennsylvania. The property was acquired by Melvin B. Shearer,
Sr. and Ruth J. Shearer, husband and wife, by deed dated August 22,1947 and
recorded October 15, 1947 in the Cumberland County Recorder of Deeds Office, a
copy of said deed being attached hereto and incorporated herein. Also including all
that certain piece or parcel of umimproved real estate, located adjacent to home.
The property was acquired by Melvin B. Shearer, Sr. and Ruth J. Shearer, husband
and wife, by deed dated May 3,1958 and recorded August 13,1958 in the
Cumberland County Recorder of Deeds office, a copy of said deed being attached
hereto and incorporated herein. The said Melvin B. Shearer, Sr. died August 23,
1997, whereupon full and complete title to the within described property became
vested solely in Ruth J. Shearer, the decedent herein. The above-described real
estate was sold pursuant to an Agreement of Sale for Real Estate dated July 28,
2005, a copy of which is attached hereto and incorporated herein. Final settlement
took place on August 31, 2005. A copy of the deed conveying said real estate,
along with a copy of the Settlement Sheet, are attached hereto and incorporated
herein. The sale price of the real estate was $95,000.00.

WHEREAS, the said Ruth J. Shearer by her Last Will and Testament,
duly proved and recorded in the Cumberland County Register of
Wills Office, Pennsylvania, in Docket Book 21-05-0195, Letters
Testamentary being issued on March 3, 2005, provided, in perti-
nent part, as follows:
THIRD: In addition to all powers granted to them by law and
by other provisions of this Will, I give the fiduciaries acting
hereunder the following powers, applicable to all property,
exercisable without court approval and effective until actual
distribution of all property:
(A) To sell at public or private sale, or to lease, for any
period of time, any real or personal property and to give options
for sale, exchanges or leases, for such prices and upon such
terms (including credit, with or without security) or conditions
as are deemed proper. This includes the power to give legally

part, by virtue of the power and authority aforesaid, in said
Will contained, and in consideration of the sum of Ninety-Five
Thousand Dollars ($95,000.00) to them paid by the said party of
the second'part, at and before the ensealing and delivery of
these presents, the receipt whereof is hereby acknowledged, have
granted, bargained, sold and conveyed, and do hereby grant,
bargain, sell and convey to the said party of the second part,
their heirs and assigns forever:

of Shiremanstown, Cumberland County, Pennsylvania, being more
fully bounded, limited and described as follows, to wit:
BEGINNING at a point on the south side of Front Street, said
point being the northeast corner of lot now or formerly of the
Shiremanstown Water Company; thence eastwardly, along the south
side of Front Street, fifty-five (55) feet, more or less, to line
of lot now or formerly of Samuel Smith; thence by the same
southwardly, one hundred eighty (180) feet, to an alley (un-
opened); thence westwardly, along said alley, fifty-five (55)
feet, more or less, to line of lot now or formerly of the said
Shiremanstown Water Company; thence along the same, northwardly,
one hundred eighty (180) feet, to Front Street, the place of
BEGINNING.
BEING the same premises which Charles W. Sheaffer, by deed
dated May 3, 1958 and recorded August 13, 1958 in the Cumberland
County Recorded of Deeds Office in Deed Book P, Volume 18, Page
176, granted and conveyed onto Melvin B. Shearer, Sr. and Ruth J.
Shearer, husband and wife. The said Melvin B. Shearer, Sr. died
August 23, 1997, whereupon full and complete title to the within
described property became vested solely in Ruth J. Shearer,
surviving spouse. The said Ruth J. Shearer died February 12,
2005.
TRACT NO. 2
ALL THAT CERTAIN piece or parcel of land situate in the Borough
of Shiremanstown, Cumberland County, Pennsylvania, being more
fully bounded, limited and described as follows, to wit:
BEGINNING at a point on the south side of Front Street at
line of land formerly of John S. Weigel; thence by said line in a
southern direction on hundred eighteen (118) feet, more or less,
to a point; thence by the same in a southeastern direction sixty-
three (63) feet, more or less, to a public alley; thence
westwardly by said public alley seventy (70) feet, more or less,
to an iron pin; thence northwestwardly one hundred seventy-six
(176) feet, more or less, to an iron pin on the southern side of
Front Street; thence eastwardly by the southern side of Front
Street twenty (20) feet, more or less, to a point, the place of
BEGINNING.
HAVING THEREON ERECTED a one-story frame bungalow.
BEING the same premises which Robert H. Smith and Irene M.
Smith, husband and wife, Paul L. Smith and Catherine Smith,
husband and wife, Lloyd V. Smith and Rebecca J. Smith, husband
and wife, and Henry Sites and Roxanna Smith Sites, husband and
wife, by deed dated August 22, 1947 and recorded October 15, 1947
in the Cumberland County Recorded of Deeds Office in Deed Book P,
Volume 13, Page 490, granted and conveyed onto Ruth Smith Shearer
and Melvin Brook Shearer, wife and husband. The said Melvin
Brook Shearer died August 23, 1997, whereupon full and complete
title to the within described property became vested solely in
Ruth Smith Shearer, also known as Ruth J. Shearer, surviving
spouse. The said Ruth J. Shearer died February 12, 2005.
TOGETHER with all and singular the rights, liberties, privileges,
hereditaments and appurtenances whatsoever thereunto belonging or
in anywise appertaining, and the reversions and remainders,
rents, issues and profits thereof, and all the estate, right,
title, interest, property, claim and demand whatsoever of the
said Ruth J. Shearer at and immediately before the time of her
decease in law or eqUity or otherwise howsoever, of, in, to or
out of the same:
TO HAVE AND TO HOLD the said granted premised to the said party
of the second part, their heirs and assigns forever.

grant and agree, to and with the said party of the second part,

ingly suffered to be done, any act, matter or thing whatsoever,
whereby the premises aforesaid, or any part thereof, is are,
shall or may be charged or encumbered, in title, charge or
estate, or otherwise howsoever.

LAST WILL AND TESTAMENT
OF
RUTH J. SHEARER
I, RUTH J. SHEARER, of the Borough of Shiremanstown,
Cumberland County, Pennsylvania, make, publish and declare this
as and for my Last Will and Testament, hereby revoking all other
Wills and Codicils heretofore made by me.
FIRST: I devise and bequeath all the rest, residue and
remainder of my estate of whatever nature and wherever situate,
including any property over which I hold power of appointment and
together with any insurance policies thereon, in equal shares, to
my children, JOAN C. McPHERSON, JAMES L. SHEARER, and SALLY R.
ESTRIGHT, provided that should any of my children predecease me,
I give and bequeath said child's share to my surviving children
as provided herein.
SECOND: No provision is made in this, my Last Will
and Testament for my granddaughters, LORI A. WEVODAU, and LISA A.
THOMAS, children of my late son, MELVIN B. SHEARER, not necessar-
ily because of any lack of affection for them, but because they
already well provided for.
THIRD: In addition to all powers granted to them by
by other provisions of this Will, I give the fiduciaries
acting hereunder the following powers, applicable to all prop-
erty, exercisable without court approval and effective until
distribution of all property:
(A) To sell at public or private sale, or to lease,
r any period of time, any real or personal property and to give
options for sales, exchanges or leases, for such prices and upon
such terms (including credit, with or without security) or
conditions as are deemed proper. This includes the power to give

legally sufficient instruments for transfer of the property and
to receive the proceeds of any disposition of it.
(B) To partition, subdivide, or improve real estate
and to enter into agreements concerning the partition, subdivi-
sion, improvement, zoning or management of real estate and to
impose or extinguish restrictions on real estate.
(C) To compromise any claim or controversy and to
abandon any property which is of little or no value.
(D) To invest in all forms of property, including
stocks, common trust funds and mortgage investment funds, without
restriction to investments authorized for Pennsylvania fiduci-
aries, as are deemed proper, without regard to any principle of
diversification, risk or productivity.
(E) To exercise any option, right or privilege granted
in insurance policies or in other investments.
(F) To exercise any election or privilege given by the
Federal and other tax laws, including, but not necessarily being
limited to, personal income, gift and estate or inheritance tax
laws.
(G) To make distributions to my herein named benefici-
aries in cash or in kind or partly in each.
(H) To borrow money from themselves or others in order
to pay debts, taxes, or estate or trust administration expenses,
to protect or improve any property held under my will, and for
investment purposes.
(I) To select a mode of payment under any qualified
retirement plan (pension plan, profit sharing plan, employee
stock ownership plan, or any other type of qualified plan) to the
extent the plan or the law permits them to do so, and to exercise
any other rights which they may have under the plan, in whatever
manner they consider advisable.

FOURTH: I direct that all inheritance, estate, trans-
fer, succession and death taxes, of any kind whatsoever, which
may be payable by reason of my death, whether or not with respect
to property passing under this will, shall be paid out of the
principal of my residuary estate.
FIFTH: All interests hereunder, whether principal or
income, which are undistributed and in the possession of the
fiduciaries acting hereunder, even though vested or distribut-
able, shall not be subject to attachment, execution or sequestra-
tion for any debt, contract, obligation or liability of any
beneficiary, and furthermore, shall not be subject to pledge,
assignment, conveyance or anticipation.
SIXTH: I nominate and appoint JAMES L. SHEARER,
Executor of this, my last will and Testament. In the event of
the death, resignation or inability to serve for any reason
whatsoever of the said JAMES L. SHEARER, I nominate and appoint
JOAN C. McPHERSON, Executrix of this, my Last Will and Testament.
I direct that my Executor or Executrix, as the case may be, and
their successors, shall not be required to post security or a
bond for the performance of their duties in any jurisdiction.
